Abstract

Penelitian ini dilakukan untuk menganalisis Kasus diantara YKCI melawan PT.Vizta Pratama Inul Vizta Karaoke mengenai Pelanggaran hak cipta dalam menjalankan rumah bisnis karaoke Inul Vizta yang tidak memiliki izin dan tidak membayarkan royalti kepada YKCI selaku pemegang hak. Melalui rangkaian Upaya Hukum Indonesia, menggunakan UUHC 2002 tentang Hak Cipta sekitar tahun 2013-2015 dengan perjuangan mendapatkan Haknya, Dengan berlakunya UUHC 2014 akhir dari penyelesaian kasus ini,YKCI diberikan kewenangan oleh UU untuk mengelola hak ekonomi pencipta, disertai lahirnya LMK dan LMKN bentukan Pemerintah yang berperan sebagai regulor yang mampu merumuskan kebijakan yang tepat demi memenuhi para pencipta. Penulis menggunakan penelitian yuridis normatif dengan menggunakan UUHC 2014 jo Permenkumham 36 Tahun 2018 Tentang Tata Cara Permohonan dan Penerbitan Izin Operasional Serta Evaluasi LMK. Penulis menganalsis Kasus YKCI melawan PT.Vizta Pratama Inul Vizta Karaoke dengan Kedudukan LMK menurut UUHC 2014 yang dihubungkan dengan keberadaan LMKN. Kesimpulan yang terdapat dalam penelitian ini YKCI menjadi LMK pertama di Indonesia dibidang pemungutan royalti karya lagu/musik berdasarkan UUHC 2014 tentang Hak Cipta menunjukan bahwa YKCI memiliki Legalitas. Keberadaan LMK dalam Bab XII dari pasal 87-93,telah mendapatkan izin operasional dari LMKN untuk menarik,menghimpun dan mendistribusikan royalti sesuai keputusan Kemenkum HAM 2016 tentang Tarif Royalti dengan sistem satu pintu untuk mehindari kemungkinan pelanggaran hak cipta. Vizta Pratama Inul Vizta Karaoke regarding copyright infringement in running the Inul Vizta karaoke business house that does not have a license and does not pay royalties to YKCI as the right holder. Through a series of Indonesian Legal Efforts, using UUHC 2002 on Copyright around 2013-2015 with the struggle to obtain rights, With the enactment of the 2014 UUHC at the end of the settlement of this case, YKCI was given the authority by law to manage the economic rights of creators, accompanied by the birth of LMK and LMKN formed by the Government who acts as a regulor who is able to formulate the right policies to satisfy the creators. The author uses normative juridical research using UUHC 2014 in conjunction with Permenkumham 36 of 2018 concerning Procedures for Application and Issuance of Operational Permits as well as LMK Evaluation. The author analyzes the YKCI case against PT Vizta Pratama Inul Vizta Karaoke with the LMK position according to UUHC 2014 which is related to the existence of LMKN. The conclusions contained in this study that YKCI became the first LMK in Indonesia in the field of collecting royalties for song / music works based on UUHC 2014 on Copyright shows that YKCI has legality. The existence of LMK in Chapter XII of articles 87-93, has obtained an operational permit from LMKN to withdraw, collect and distribute royalties according to the 2016 Ministry of Law and Human Rights decision regarding Royalty Rates with a one-door system to avoid possible copyright infringement Keyword :Royalty ,Collective Management ,Composer,Song,Music
