Abstract

Judul Tesis : Transformasi Perlindungan Hukum terhadap Investor Asing dalam Perspektif Undang-Undang Cipta Kerja Kata Kunci : Politik Hukum, Investasi, Undang-Undang Cipta Kerja Investasi asing memiliki peranan strategis dalam mendorong pembangunan ekonomi dan peningkatan kesejahteraan masyarakat Indonesia. Melalui investasi, telah diakui terjadi penciptaan lapangan kerja, transfer keahlian, pengetahuan serta teknologi, serta peningkatan pendapatan nasional. Namun demikian, investor asing menghadapi berbagai kendala yang cukup kompleks, antara lain ketidakpastian hukum, birokrasi yang rumit, tumpang tindih regulasi, serta ketidakpastian iklim investasi. Untuk mengatasi hambatan-hambatan tersebut, pemerintah Indonesia menginisiasi dan mengesahkan Undang-Undang Cipta Kerja sebagai bentuk transformasi hukum melalui pendekatan omnibus law. Undang-Undang ini bertujuan menyederhanakan proses perizinan, mengurangi birokrasi yang berbelit, serta meningkatkan kepastian hukum sehingga menciptakan iklim investasi yang lebih kondusif. Penelitian ini menggunakan pendekatan politik hukum yang memandang hukum sebagai manifestasi dari kehendak politik penguasa. Kajian diarahkan untuk menganalisis bagaimana Undang-Undang Cipta Kerja mentransformasikan perlindungan hukum bagi investor asing, serta menelaah tantangan hukum yang dihadapi baik sebelum maupun sesudah penerapan Undang- Undang tersebut. Metode penelitian yang digunakan adalah penelitian hukum normatif yang memadukan data primer dari instrumen hukum yang relevan dan data sekunder dari telaah pustaka. Analisis data dilakukan dengan metode yuridis-normatif guna memberikan gambaran komprehensif terhadap aspek hukum investasi di Indonesia. Hasil penelitian menunjukkan bahwa Undang-Undang Cipta Kerja berhasil menyederhanakan prosedur investasi dan memberikan jaminan kepastian hukum yang lebih baik bagi investor asing. Pemerintah berupaya mengharmonisasikan regulasi yang sebelumnya tumpang tindih dan membangun sistem perizinan berbasis risiko secara elektronik melalui sistem Online Single Submission (OSS), pemangkasan durasi waktu perizinan, serta penerapan Pelayanan Terpadu Satu Pintu (PTSP) di tiap daerah. Meski demikian, dalam tahap dari sisi legal drafting sampai pada tahap Undang-Undang Cipta Kerja dinilai oleh publik masih ditemukan sejumlah masalah kendala praktis yang justru dikhawatirkan akan berdampak kepada konflik sosial, serta tantangan yang harus segera ditangani oleh pemangku kepentingan agar tujuan percepatan investasi dan peningkatan kesejahteraan masyarakat dapat terwujud secara optimal. Temuan ini menggarisbawahi pentingnya dukungan politik hukum yang konsisten dan penguatan mekanisme penegakan hukum dalam mendorong iklim investasi yang stabil dan berkelanjutan. / Thesis Title : Transformation of Legal Protection for Foreign Investors from the Perspective of Undang-Undang Cipta Kerja Keywords : Legal Politics, Investment, Undang-Undang Cipta Kerja Foreign investment plays a strategic role in driving Indonesia's economic development and improving public welfare. Through investment, it is acknowledged that job creation, transfer of expertise, knowledge and technology, as well as an increase in national income have occurred. However, foreign investors face quite complex obstacles, including legal uncertainty, complicated bureaucracy, overlapping regulations, and an uncertain investment climate. To overcome these barriers, the Indonesian government initiated and enacted Undang-Undang Cipta Kerja as a form of legal transformation through the omnibus law approach. This law aims to simplify licensing processes, reduce bureaucratic complexity, and enhance legal certainty to create a more conducive investment climate. This study uses a legal politics approach that views law as a manifestation of the political will of those in power. The research is directed to analyze how Undang-Undang Cipta Kerja transforms legal protection for foreign investors and examines the legal challenges faced both before and after its implementation. The research method employed is normative legal research combining primary data from relevant legal instruments and secondary data from literature review. Data analysis is conducted using juridical-normative methods to provide a comprehensive overview of the legal aspects of investment in Indonesia. The research findings show that Undang-Undang Cipta Kerja successfully simplifies investment procedures and provides better legal certainty for foreign investors. The government strives to harmonize previously overlapping regulations and develop a risk-based licensing system electronically through the Online Single Submission (OSS) system, shorten licensing durations, and implement One-Stop Integrated Services (PTSP) in each region. Nonetheless, from legal drafting stages to the enactment of the Job Creation Law, the public still identifies several practical obstacles that raise concerns about potential social conflicts, as well as challenges that must be promptly addressed by stakeholders to optimally realize the objectives of accelerating investment and improving public welfare. These findings underline the importance of consistent legal-political support and strengthening law enforcement mechanisms in fostering a stable and sustainable investment climate.
