Abstract

Pemutusan Hubungan Kerja (PHK) karena alasan efisiensi pada perusahaan teknologi rintisan (startup) semakin meningkat seiring perubahan dinamika industri digital dan kebutuhan restrukturisasi bisnis. Penelitian ini bertujuan untuk menganalisis penerapan regulasi PHK karena efisiensi serta menilai pertimbangan hukum majelis hakim dalam Putusan Mahkamah Agung Nomor 31 K/Pdt.Sus-PHI/2023. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus. Hasil penelitian menunjukkan bahwa meskipun regulasi terkait PHK karena efisiensi telah diatur dalam Peraturan Pemerintah, penerapannya belum sepenuhnya memberikan perlindungan hukum yang optimal bagi pekerja di perusahaan rintisan. Permasalahan muncul karena karakteristik perusahaan rintisan yang tidak stabil, berubah cepat, serta tidak diatur secara spesifik dalam regulasi ketenagakerjaan. Studi kasus pada putusan Mahkamah Agung menunjukkan bahwa hakim mempertimbangkan unsur keadilan, kepastian hukum, dan kemanfaatan, namun masih terdapat ketidakseimbangan antara kepentingan pengusaha dan hak pekerja. Penelitian ini menegaskan perlunya regulasi yang lebih responsif dan kontekstual terhadap dinamika industri teknologi./Employment Termination (PHK) due to efficiency in technology startup companies has become increasingly common in response to rapid digital industry changes and business restructuring needs. This research aims to analyze the implementation of regulations on efficiency-based termination and evaluate the legal reasoning of judges in Supreme Court Decision Number 31 K/Pdt.Sus-PHI/2023. The study employs a normative juridical method with statutory and case approaches. The findings indicate that although regulations on efficiency-based termination are stipulated Government Regulation, their implementation does not fully ensure optimal legal protection for workers in startup companies. Challenges arise due to the inherently unstable and rapidly changing nature of startups, which is not explicitly regulated within Indonesian labor law. The case analysis reveals that the Supreme Court considered principles of justice, legal certainty, and utility; however, imbalance remains between employer interests and worker rights. This study highlights the need for more adaptive and contextual regulations that align with the dynamics of the technology sector
