Abstract

Penyalahgunaan data pribadi oleh orang-orang tertentu termasuk pula oknum dalam perusahaan bisnis telah menjadi bentuk kerugian banyak orang yang berkembang seiring dengan kemajuan teknologi digital, di mana berbagai aktivitas kini dapat dilakukan melalui media digital. Sejak tahun 2021 sudah banyak terjadi kasus kebocoran data konsumen. meskipun UU PDP telah diberlakukan, implementasinya masih menemui berbagai kendala, seperti kurangnya pengawasan yang efektif, belum adanya otoritas independen yang bertanggung jawab penuh terhadap perlindungan data pribadi, serta kurangnya kesadaran bisnis digital dalam mematuhi aturan baru. Jenis penelitian yang diangkat adalah penelitian Yuridis Normatif (library legal research), sebagaimana ditunjukkan oleh judul tesis ini. Sumber data penelitian ini adalah data sekunder. Konsep hukum, gagasan hukum, doktrin hukum, dan aturan yang relevan dapat dikutip, disalin, dan dianalisis untuk mendapatkan data sekunder dari penelitian kepustakaan. Metode pendekatan yang digunakan dalam tesis ini adalah Metode Pendekatan Yuridis Normatif. Permasalahan dalam tesis ini membahasa mengenai Kepastian Hukum Terhadap Konsumen Yang Mengalami Pelanggaran Data Pribadi Dalam Transaksi Bisnis Digital Berdasarkan Undang-Undang Nomor 27 Tahun 2022 Tentang Pelindungan Data Pribadi Dan Upaya Pelindungan Hukum Bagi Konsumen Data Pribadi Yang Dirugikan Dari Transaksi Bisnis Digital. Kepastian Hukum terhadap konsumen yang mengalami pelanggaran Data Pribadi dalam transaksi bisnis digital melalui UU No. 27 Tahun 2022 memberikan kepastian hukum bagi konsumen melalui Pasal 7-14, khususnya Pasal 12 ayat (1) yang memungkinkan subjek data menggugat dan menuntut ganti rugi atas pelanggaran pengolahan data pribadi. Konsumen juga berhak mengakses, mengubah, menghapus, atau membatasi pengolahan data per Pasal 15-20. Sebaliknya, UU Perlindungan Konsumen (UU No. 8 Tahun 1999) tidak secara spesifik mengatur data pribadi, hanya Pasal 45 yang membolehkan gugatan umum atas kerugian akibat pelaku usaha. Selanjutnya, Pemerintah melindungi konsumen bisnis digital melalui OJK (UU No. 21 Tahun 2011, Pasal 8-9) sebagai pengawas jasa keuangan, Direktorat Pemberdayaan Konsumen Kemendag, dan Ditjen PKTN via KOMDIGI untuk sosialisasi hak konsumen, termasuk kewajiban informasi pelaku usaha (PP No. 80 Tahun 2019 Pasal 53) dan gugatan perdata (Pasal 45 UU PK jo. Pasal 12 UU PDP). Kendala utama: pengawasan tidak efektif, belum ada otoritas PDP independen hingga 2025 (tugas tersebar), kapasitas pengawas kurang, serta rendahnya kesadaran konsumen dan pelaku usaha. Kata Kunci: Perlindungan Hukum, Data Pribadi, Bisnis Digital. / The misuse of personal data by certain individuals, including individuals within business entities, has become a form of loss for many people, growing alongside advances in digital technology, where various activities can now be conducted digitally. Since 2021, numerous cases of consumer data breaches have occurred. Although the Personal Data Protection Law (PDP) has been enacted, its implementation still faces various obstacles, such as a lack of effective oversight, the absence of an independent authority fully responsible for personal data protection, and a lack of awareness among digital businesses regarding compliance with the new regulations. The type of research undertaken is legal-normative research (library legal research), as indicated by the title of this thesis. The data sources for this research are secondary data. Legal concepts, legal ideas, legal doctrines, and relevant regulations can be cited, copied, and analyzed to obtain secondary data from library research. The approach used in this thesis is the legal-normative approach. The problem in this thesis discusses the Legal Certainty for Consumers Who Experience Personal Data Violations in Digital Business Transactions Based on Law Number 27 of 2022 Concerning Personal Data Protection and Legal Protection Efforts for Consumers with Personal Data Harmed by Digital Business Transactions. Legal certainty for consumers who experience personal data violations in digital business transactions through Law No. 27 of 2022 provides legal certainty for consumers through Articles 7-14, especially Article 12 paragraph (1) which allows data subjects to sue and claim compensation for violations of personal data processing. Consumers also have the right to access, change, delete, or limit data processing per Articles 15-20. In contrast, the Consumer Protection Law (Law No. 8 of 1999) does not specifically regulate personal data, only Article 45 allows for general lawsuits for losses caused by business actors. Furthermore, the Government protects digital business consumers through the Financial Services Authority (OJK) (Law No. 21 of 2011, Articles 8-9) as the financial services supervisor, the Directorate of Consumer Empowerment of the Ministry of Trade, and the Directorate General of PKTN via KOMDIGI to socialize consumer rights, including business actors' information obligations (PP No. 80 of 2019 Article 53) and civil lawsuits (Article 45 of the PK Law in conjunction with Article 12 of the PDP Law). The main obstacles: ineffective supervision, no independent PDP authority until 2025 (distributed tasks), insufficient supervisory capacity, and low consumer and business awareness.
