Abstract

Berbagai macam metode jual-beli, seperti e-commerce, muncul di era digital. Sejak tahun 2020, penggunaan e-commerce di Indonesia terus meningkat. Menurut Kementerian Perdagangan Republik Indonesia menunjukkan bahwa pengguna e-commerce di Indonesia pada tahun 2020 dan terus meningkat sampai pada tahun 2023, dan diperkirakan akan terus meningkat sampai pada tahun 2029. Tak hanya e-commerce, namun muncul berbagai bentuk transaksi online baru yang lebih mengerucut pada suatu objek pada suatu game online yang dimana menargetkan konsumen yang bermain game tertentu. Di Indonesia sendiri telah diterbitkan nya beberapa peraturan perundang-undangan yang mengatur tentang transaksi online dan usaha-usaha elektronik, Penyelenggara Sistem Elektronik (PSE) dan Perdagangan Melalui Sistem Elektronik, namun meski demikian masih banyak celah-celah bagi pemerintah untuk melindungi segenap rakyat nya dalam hal sengketa transaksi elektronik, yang dimana pemerintah harus lebih gencar dan ketat dalam penerapan dan perlindungan hukum. Penelitian ini merupakan penelitian yuridis normatif mengarah pada peraturan perundang-undangan, putusan pengadilan, dan standar hukum umum. Dalam penelitian ini hanya mengerucutkan pada wanprestasi berdasarkan perspektif hukum perdata. Data yang digunakan dalam penelitian ini adalah bahan hukum primer, sekunder dan tersier. Dari hasil penelitian ini dapat disimpulkan bahwa dalam jual-beli barang di Community Server Dragon Nest Return, konsumen tidak sepenuh mendapat perlindungan hukum, sehingga negara dalam hal ini memiliki tanggungjawab untuk memberikan perlindungan hukum dalam hal ini. Dalam hal penyelesaian sengketa terkait jual-beli ini juga memiliki penyelesaian secara alternatif penyelesaian sengketa dan secara litigasi. / Various methods of buying and selling, such as e-commerce, have emerged in the digital era. Since 2020, the use of e-commerce in Indonesia has continued to increase. According to the Ministry of Trade of the Republic of Indonesia, the number of e-commerce users in Indonesia in 2020 continued to increase until 2023, and is expected to keep rising until 2029. Not only e-commerce, but various new forms of online transactions have emerged, focusing more on specific objects within certain online games that target consumers who play specific games. In Indonesia, several regulations have been issued to govern online transactions and electronic businesses, Electronic System Organizers (PSE), and Electronic System Commerce. However, there are still many gaps for the government to protect all its citizens in terms of electronic transaction disputes, where the government needs to be more vigorous and strict in the implementation and legal protection. This research is a normative juridical study focusing on legislation, court decisions, and general legal standards. In this research, the focus is solely on default based on the perspective of civil law. The data used in this research are primary, secondary, and tertiary From the results of this research, it can be concluded that in the buying and selling of goods on the Community Server Dragon Nest Return, consumers do not fully receive legal protection, so the state has a responsibility to provide legal protection in this matter. In terms of resolving disputes related to this buying and selling, there are also alternative dispute resolution methods and litigation.
