Abstract

Penelitian ini bertujuan untuk mengetahui bagaimana perlindungan hukum terhadap konsumen atas keterlambatan pengiriman barang oleh perusahaan ekspedisi berdasarkan Undang-Undang Perlindungan Konsumen dan untuk mengetahui bagaimana penerapan hukum terhadap putusan No. 295/PDT.SUS.BPSK/2020/PN.BKS. penelitian ini menggunakan acuan teori kepastian hukum dan teori perlindungan hukum. Dalam penelitian ini, metode yang digunakan adalah bersifat yuridis normatif. Teknik pengumpulan data yang digunakan adalah studi kepustakaan, yaitu penelitian terhadap data sekunder yang mengacu terhadap norma hukum pada peraturan perundang-undangan dan putusan pengadilan. Dari hasil penelitian ini disimpulkan bahwa Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen memberikan perlindungan terhadap konsumen yang dirugikan. Keterlambatan pengiriman barang konsumen yang dapat memperoleh ganti kerugian dari perusahaan ekspedisi adalah keterlambatan yang disebabkan oleh kelalaian yang dilakukan karyawan perusahaan ekspedisi tersebut. Selanjutnya pemberian sanksi administrasi dan sanksi pidana dalam kasus ini tidak tepat dan perlu adanya perbaikan, merujuk pada Undang-Undang Perlindungan Konsumen. / This study aims to find out how the legal protection of consumers for late delivery of goods by shipping companies based on the Consumer Protection Law and to find out how the law applies to decision No. 295/PDT. SUS. BPSK/2020/PN. BKS. This research uses references to the theory of legal certainty and the theory of legal protection. In this study, the method used was normative juridical. The data collection technique used is a literature study, which is a study of secondary data that refers to legal norms in laws and regulations and court decisions. From the results of this study, it is concluded that Law Number 8 of 1999 concerning Consumer Protection provides protection for aggrieved consumers. Delays in the delivery of consumer goods that can obtain compensation from the shipping company are delays caused by negligence made by employees of the shipping company. Furthermore, the provision of administrative sanctions and criminal sanctions in this case is inappropriate and there needs to be improvement, referring to the Consumer Protection Law.
