Abstract

ABSTRAK Judul Tesis: PERJANJIAN KERJA LAUT (PKL) BAGI CREW KAPAL HARBOUR TUG PT. WARUNA NUSA SENTANA JAKARTA Perjanjian Kerja Laut merupakan landasan hukum dan kerangka kerja yang memengaruhi kehidupan profesional dan kesejahteraan awak kapal di industri maritim. Tesis ini menjelajahi bentuk Perjanjian Kerja Laut beserta upaya hukum yang dapat dilakukan atas permasalahan yang terjadi dalam Perjanjian Kerja Laut bagi awak kapal Harbour Tug pada PT. Waruna Nusa Sentana Jakarta perusahaan pelayaran terkemuka di Jakarta, didasarkan kepada peraturan perundang-undangan yang berlaku di Indonesia. Penelitian ini mencakup analisis mendalam terhadap Perjanjian Kerja Laut yang diterapkan oleh PT. Waruna Nusa Sentana Jakarta, dengan fokus pada keabsahan Perjanjian Kerja Laut, penerapan Perjanjian Kerja Laut, hambatan dalam penerapan Perjanjian Kerja Laut, serta penyelesaian masalah bila terjadi sengketa dalam Perjanjian Kerja Laut pada crew kapal Harbour Tug PT. Waruna Nusa Sentana Jakarta. Melalui pendekatan campuran yang melibatkan survei, dan tinjauan dokumen, tesis ini mengungkap tentang berbagai perspektif dan pengalaman individu dalam hubungan kerja laut. Hasil penelitian menyoroti variasi dalam Perjanjian Kerja Laut yang diterapkan di perusahaan pelayaran ini serta implikasinya pada kesejahteraan dan motivasi awak kapal. Dalam arti yang lebih luas, tesis ini juga membahas tantangan dan peluang yang dihadapi oleh perusahaan pelayaran dan pemerintah dalam memastikan perlindungan hak-hak pekerja maritim serta menjaga keberlanjutan industri maritim. Hasil penelitian tesis ini mengungkapkan sejumlah temuan yang relevan, termasuk Perjanjian Kerja Laut tidak diperkenankan secara lisan, bentuk Perjanjian Kerja Laut dan upaya hukum yang dapat dilakukan atas permasalahan yang terjadi dalam Perjanjian Kerja Laut Bagi Awak Kapal Harbour Tug pada PT. Waruna Nusa Sentana Jakarta yang dapat dikelompokkan menjadi penyelesaian secara Litigasi atau melalui Pengadilan, atau secara Non Litigasi yang dapat dilakukan melalui musyawarah mufakat, konsiliasi maupun mediasi sesuai peraturan perundang-undangan yang berlaku. The Maritime Employment Agreement is the legal basis and framework that influences the professional lives and welfare of ship crew in the maritime industry. This thesis explores the form of a Maritime Work Agreement along with the legal remedies that can be taken regarding problems that occur in the Maritime Work Agreement for Harbor Tug crew members at PT. Waruna Nusa Sentana Jakarta is a leading shipping company in Jakarta, based on the laws and regulations in force in Indonesia. This research includes an in-depth analysis of the Maritime Work Agreement implemented by PT. Waruna Nusa Sentana Jakarta, with a focus on the validity of the Maritime Work Agreement, implementation of the Maritime Work Agreement, obstacles in implementing the Maritime Work Agreement, as well as resolving problems if there is a dispute in the Maritime Work Agreement on the crew of the PT Harbor Tug ship. Waruna Nusa Sentana Jakarta. Through a mixed approach involving surveys, and document reviews, this thesis uncovers a variety of individual perspectives and experiences in maritime employment relations. The research results highlight the variations in Maritime Labor Agreements implemented in these shipping companies and their implications for the welfare and motivation of ship crews. In a broader context, this thesis also discusses the challenges and opportunities faced by shipping companies and the government in ensuring the protection of maritime workers' rights and maintaining the sustainability of the maritime industry. The results of this thesis research reveal a number of relevant findings, including whether verbal Maritime Work Agreements are permitted, the form of Maritime Work Agreements and legal remedies that can be taken for problems that occur in the Maritime Work Agreement for Harbor Tug Crew at PT. Waruna Nusa Sentana Jakarta which can be grouped into litigation or through court, or non-litigation which can be done through consensus deliberation, conciliation or mediation in accordance with applicable laws and regulations.
