Abstract

ABSTRAK Judul : Perlindungan Hukum Kepada Pengelola Terminal Peti Kemas Terhadap Kerusakan Peti Kemas Dalam Pelayanan Bongkar Muat Peti Kemas di Pt. Jakarta International Container Terminal “PT.JICT Perlindungan hukum perusahaan jasa bongkar muat di Indonesia diatur dalam berbagai peraturan perundang-undangan. Perlindungan hukum tersebut bertujuan untuk menciptakan kepastian hukum, mencegah terjadinya pelanggaran hukum, meningkatkan kepercayaan masyarakat, dan mendorong pertumbuhan ekonomi. Berdasarkan peraturan perundang-undangan tersebut, pengelola terminal peti kemas bertanggung jawab atas kerusakan peti kemas yang terjadi dalam pelayanan bongkar muat peti kemas, jika kerusakan tersebut disebabkan oleh kelalaian atau kesalahan pengelola terminal peti kemas. PT. Jakarta International Container Terminal “PT. JICT” sebagai pengelola terminal peti kemas di Indonesia memiliki tanggung jawab yang besar dalam menjaga keamanan dan keselamatan peti kemas dalam pelayanan bongkar muat peti kemas. PT. JICT perlu menerapkan standar keamanan dan keselamatan yang tinggi untuk mengurangi risiko terjadinya kerusakan peti kemas. Jenis penelitian yang dipergunakan ketika penyusunan tesis ialah penelitian yuridis normatif (metode penelitian hukum normatif). Penelitian ini mengkaji dan menganalisis bahan-bahan pustaka berupa peraturan perundangundangan, putusan pengadilan, dan literatur-literatur yang berkaitan dengan permasalahan yang akan dibahas. Metode pendekatan masalah berbeda dengan metode atau tipe penelitian dalam upaya memecahkan permasalahan yang diambil. Dari hasil penelitian di peroleh bahwa Pengelola terminal peti kemas harus memenuhi semua persyaratan yang ditetapkan dalam peraturan perundang-undangan untuk memaksimalkan perlindungan hukum. Mereka juga harus menerapkan praktik bisnis yang baik dan bertanggung jawab. Selanjutnya, Pengelola terminal peti kemas bertanggung jawab atas kerusakan peti kemas yang terjadi dalam pelayanan bongkar muat peti kemas, jika kerusakan tersebut disebabkan oleh kelalaian atau kesalahan pengelola terminal peti kemas, Kelalain atau kesalahan pengelola terminal peti kemas dapat berupa kesalahan dalam melakukan kegiatan bongkar muat peti kemas atau kesalahan dalam menjaga keamanan dan keselamatan peti kemas Kata Kunci: Perlindungan Hukum, Bongkar Muat, Peti Kemas, dan PT. Jakarta International Container Terminal. / ABSTRACT Title : Legal Protection to Container Terminal Managers Against Container Damage in Container Loading and Unloading Services at Pt. Jakarta International Container Terminal "PT.JICT The legal protection of loading and unloading service companies in Indonesia is regulated in various laws and regulations. The legal protection aims to create legal certainty, prevent violations of the law, increase public confidence, and encourage economic growth. Based on these laws and regulations, container terminal managers are responsible for container damage that occurs in container loading and unloading services, if the damage is caused by negligence or fault of the container terminal manager. PT Jakarta International Container Terminal "PT JICT" as a container terminal manager in Indonesia has a great responsibility in maintaining the security and safety of containers in container loading and unloading services. PT JICT needs to implement high security and safety standards to reduce the risk of container damage. The type of research used when preparing the thesis is normative juridical research (normative legal research method). This research examines and analyses library materials in the form of laws and regulations, court decisions, and literature related to the problems to be discussed. The method of approaching the problem is different from the method or type of research in an effort to solve the problems taken. From the research results, it is found that container terminal managers must fulfil all the requirements set out in the legislation to maximise legal protection. They must also implement good and responsible business practices. Furthermore, container terminal managers are responsible for damage to containers that occur in container loading and unloading services, if the damage is caused by negligence or fault of the container terminal manager, negligence or fault of the container terminal manager can be in the form of errors in carrying out container loading and unloading activities or errors in maintaining the security and safety of containers.
