Abstract

ABSTRAK Judul : Analisis yuridis pertanggungjawaban asuransi Terhadap kecelakaan kapal di laut Kecelakaan kapal merupakan salah satu risiko yang dapat terjadi dalam kegiatan pelayaran. Risiko tersebut dapat menimbulkan kerugian yang besar, baik bagi pemilik kapal maupun Pihak ketiga. Asuransi kapal merupakan salah satu instrumen penting untuk melindungi pemilik kapal dan pihak lain yang mengalami kerugian akibat kecelakaan kapal. Namun, pemilik kapal perlu memahami dengan baik ketentuan asuransi kapal agar dapat memperoleh manfaat yang maksimal. Jenis penelitian yang digunakan adalah yuridis normatif Penelitian hukum doktrinal yang dikonsepkan sebagai kaidah-kaidah perundangan, dan penelitian hukum. Karena dalam penelitian hukum normatif meneliti literatur dan bahan Pustaka, maka ada juga yang menggolongkan penelitian hukum normatif sebagai penelitian kepustakaan. Dari hasil penelitian diperoleh, bahwa Pertanggungjawaban pihak asuransi terhadap kecelakaan kapal di laut sangat penting untuk memberikan kepastian hukum dan keadilan bagi semua pihak yang terlibat. Ini membutuhkan kepastian hukum agar semua pihak mengetahui hak dan kewajibannya masingmasing, dan keadilan untuk memastikan bahwa semua pihak mendapatkan perlakuan yang adil sesuai dengan kerugian yang mereka alami. Selanjutnya, Untuk melindungi hak dan kepentingan masing-masing pihak, pihak asuransi memberikan perlindungan hukum dan kepastian hukum terhadap kapal yang mengalami kecelakaan di laut. Dengan adanya perlindungan dan kepastian hukum, masalah para pihak yang terlibat dalam kecelakaan kapal akan lebih mudah diselesaikan secara adil. Kata Kunci: Analisis Yuridis, Pertanggungjawaban Hukum, Asuransi Kapal, dan Kecelakaan Kapal. / ABSTRACT Title : Juridical analysis of insurance liability for ship accidents at sea Ship accidents are one of the risks that can occur in shipping activities. Ship insurance is one of the important instruments to protect ship owners and other parties who suffer losses due to ship accidents. However, shipowners need to understand well the provisions of ship insurance in order to obtain maximum benefits. The type of research used is normative juridical Doctrinal legal research which is conceptualised as rules of legislation, and legal research. Because normative legal research examines literature and library materials, some also classify normative legal research as library research. From the results of the research obtained, that the liability of liability for ship accidents at sea is very important to provide legal certainty and justice for all parties involved. provide legal certainty and justice for all parties involved. This requires legal certainty so that all parties know their respective rights and obligations, and justice to ensure that all parties get fair treatment in accordance with the losses they experience. in accordance with the losses they have suffered.
