Abstract

Pembatalan penerbangan oleh pihak maskapai seringkali terjadi, hal ini tentu saja merugikan konsumen karena mereka membeli tiket pesawaat dengan harapan tepat waktu dan cepat sampai ke tujuan dibandingkan dengan moda transportasi lainnya. Metode penelitian yang digunakan dalam penulisan ini merupakan jenis penelitian hukum normatif dengan pendekatan yuridis normatif. Data yang digunakan adalah jenis data sekunder berupa bahan hukum premier, bahan hukum sekunder dan bahan hukum tersier. Rumusan masalah dalam penelitian ini adalah bagaimana perlindungan hukum bagi penumpang pesawat akibat adanya keterlambatan atau pembatalan penerbangan dan bagaimana pertanggungjawaban maskapai penerbangan kepada penumpang pesawat akibat adanya keterlambatan/pembatalalan penerbangan berdasarkan Putusan Nomor : 441/PDT.G/2013/PN.JK.PST. Hasil penelitian adalah perlindungan hukum bagi penumpang pesawat akibat adanya keterlambatan atau pembatalan penerbangan diatur dalam pasal 4 huruf (h) Undang-undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen, jo Pasal 2, jo Pasal 9, jo Pasal 10, jo Pasal 11, jo Pasal 12 Peraturan Menteri Perhubungan Nomor 77 Tahun 2011 tentang Tanggung Jawab Pengangkutan Angkutan Udara, dan Peraturan Menteri Perhubungan Nomor 25 Tahun 2008 tentang Penyelenggaraan Angkutan Udara dan pertanggungjawaban maskapai penerbangan kepada penumpang pesawat akibat adanya keterlamabtan atau pembatalan penerbangan berdasarkan Putusan Nomor: 441/PDT.G/2013/PN.JKT.PST, bahwa Majelis Hakim yang Memeriksa dan Mengadili Perkara tersebut Memutuskan bahwa perbuatan yang dilakukan oleh maskapai penerbangan Lion Air yang telah mengakibatkan kerugian bagi penumpang (konsumen) adalah merupakan Perbuatan Melawan Hukum berdasarkan Pasal 1365 KUHPerdata. / Flight cancellations by airlines often occur, this is of course detrimental to consumers because they buy airplane tickets in the hope of arriving on time and quickly to their destination compared to other modes of transportation. The research method used in this paper is a type of normative legal research with a normative juridical approach. The data used are secondary data types in the form of premier legal materials, secondary legal materials and tertiary legal materials. The formulation of the problem in this study is how is the legal protection for airplane passengers due to flight delays or cancellations and how is the responsibility of airlines to airplane passengers due to flight delays/cancellations based on Decision Number: 441/PDT.G/2013/PN.JK.PST. The results of the study are legal protection for airplane passengers due to flight delays or cancellations regulated in article 4 letter (h) of Law Number 8 of 1999 concerning Consumer Protection, in conjunction with Article 2, in conjunction with Article 9, in conjunction with Article 10, in conjunction with Article 11, in conjunction with Article 11, in conjunction with Article 12 Regulation of the Minister of Transportation Number 77 of 2011 concerning Responsibility for Air Transportation, and Regulation of the Minister of Transportation Number 25 of 2008 concerning the Implementation of Air Transportation and the responsibility of airlines to airplane passengers due to flight delays or cancellations based on Decision Number: 441/PDT.G /2013/PN.JKT.PST, that the Panel of Judges Examining and Trying the Case Decided that the actions committed by the airline Lion Air which resulted in losses for passengers (consumers) were unlawful under Article 1365 of the Civil Code.
