Abstract
Penelitian ini mengkaji perlindungan hukum hak kompensasi PHK Buruh dalam hal perseroan yang telah mencadangkan imbalan kerja (Pernyataan Standar Akuntansi 24) Pailit, karena pada Putusan Mahkamah Konstitusi No. 67/PUU-XI-2013 (“Putusan MK 67/13”) dan juga Perubahan Pasal 95 Undang-Undang Nomor 13 Tahun 2003 (“UUK”) dalam Undang-Undang Nomor 11 Tahun 2020 tentang Cipta Kerja (“UUCK”), mengenai Hak Buruh Lainnya dan Upah yang dibedakan peringkatnya tentu menimbulkan permasalahan, sehingga menimbulkan kebingungan dan pertentangan. Hal tersebut terjadi dikarenakan dalam Putusan MK 67/13 dan Pasal 95 Bab IV UUCK memisahkan peringkat Upah Buruh atau Pekerja dengan Hak Buruh atau Pekerja lainnya. Hal ini menimbulkan pertanyaan, mengapa hak-hak tersebut harus dipisahkan pengaturannya sehingga untuk hak-hak Pekerja/Buruh lainnya harus dikesampingkan dengan adanya Kreditor Separatis. Berdasarkan filosofisnya hak pesangon harus dibayarkan untuk menjamin atau menunjang Buruh yang kehilangan Pekerjaan dapat memenuhi kebutuhannya hingga sampai ia mendapatkan Pekerjaan kembali, namun Putusan MK 67/13 dan Pasal 95 Bab IV UUCK yang memisahkan peringkat Upah Pekerja/Buruh dengan Hak-hak Pekerja/Buruh lainnya Hak Buruh/Pekerja untuk mendapatkan Pesangon bergeser kedudukannya oleh Kreditor Separatis, hal tersebut sangat tidak mempresentasikan negara kita sebagai negara yang berpedoman pada Pancasila, yang memiliki nilai-nilai luhur seperti yang terkandung dalam sila kedua Pancasila, oleh karena itu terhadap penelitian ini terdapat beberapa masalah hukum yaitu benturan hukum yang antara Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan PKPU (“UUKPKPU”), UUK, dan UUCK. Kata Kunci: Perlindungan Hukum, Hak Kompensasi, Buruh, Kepailitan, PSAK 24, Perseroan./ This study examines the legal protection of workers' compensation rights for layoffs in the event that a company that has reserved employee benefits (psak 24) goes bankrupt, because of the Constitutional Court Decision Number 67/PUU-XI-2013 and also the Amendment to Article 95 of Law Number 13 of 2003 in Law of the Republic Indonesia No. 11 of 2020 on job creation, regarding wages and other workers' rights, which are differentiated in rank, certainly creates problems, causing confusion and conflict. This happened because in the decision of the Constitutional Court Number 67/PUU-XI-2013 and Article 95 Chapter IV of Law of the Republic Indonesia no. 11 of 2020 separates the rank of Wages of Workers/Labourers from the Rights of other Workers/Labourers. This raises the question, why should these rights be separated in their arrangements so that the rights of other workers/labourers must be ruled out by the existence of separate creditors. Based on his philosophy, severance pay must be paid to guarantee or support workers who have lost their jobs to fulfill their needs until they get a job again, but with the decision of the Constitutional Court Number 67/PUU-XI-2013 and Article 95 Chapter IV of Law of the Republic Indonesia No. 11 of 2020 which separates the rank of Wages of Workers/Labourers from the Rights of other Workers/Labourers. The rights of workers/workers to get severance pay are shifted in position by Separatist Creditors, this does not represent our country as a Pancasila state, which has noble values for humanity. fair and civilized, therefore in this research there are several legal problems, namely the conflict of law between Law Number 37 of 2004 concerning Bankruptcy and PKPU, Law of the Republic Indonesia Number 13 of 2003 concerning Manpower, Law of the Republic Indonesia Number 11 of 2020 on Job Creation.
