Abstract

Pasal 18 ayat (6) Undang-Undang Dasar 1945; Undang-Undang Nomor 17 Tahun 2014 tentang MPR, DPR, DPD dan DPRD; dan Undang-Undang Nomor 23 Tahun 2014 tentang Pemerintahan Daerah menjadi fondasi hukum pelaksanaan fungsi legislasi DPRD dalam membentuk peraturan daerah (Perda). Penelitian ini menganalisis pelaksanaan fungsi legislasi DPRD selama tahun 2017-2021 dan proses pembentukan Perda di Provinsi DKI Jakarta, dengan menggunakan metode penelitian hukum normatif. Hasil penelitian menunjukkan, DPRD Provinsi DKI Jakarta belum menjalankan fungsi legislasinya secara optimal. Hal ini terlihat melalui minimnya inisiatif rancangan peraturan daerah (Raperda) Provinsi DKI Jakarta yang berasal dari DPRD selama tahun 2017-2021, dari 150 Raperda hanya 30 Raperda (20%) yang berasal dari inisiatif DPRD, selebihnya merupakan inisiatif Gubernur. Dari total 150 Raperda, hanya sebanyak 38 Raperda (25%) yang telah ditetapkan menjadi Perda, yang semuanya adalah inisiatif eksekutif, tidak ada inisiatif DPRD. Proses pembentukan Perda di Provinsi DKI Jakarta sudah sesuai dengan Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-Undangan dan Permendagri Nomor 80 Tahun 2015 tentang Pembentukan Produk Hukum Daerah yang telah diubah dengan dengan Permendagri Nomor 120 Tahun 2018 tentang Perubahan atas Permendagri Nomor 80 Tahun 2015 tentang Pembentukan Produk Hukum Daerah. This study analyzes the implementation of the legislative function of DPRD during 2017-2021 and the process of forming a regional regulation in DKI Jakarta Province, using normative legal research methods. The results showed that the DKI Jakarta Provincial DPRD has not carried out its legislative function optimally. This can be seen through the lack of initiatives to draft regional regulations (Raperda) of DKI Jakarta Province originating from the DPRD during 2017-2021, of the 150 Raperda only 30 Raperda (20%) came from the DPRD initiative, the rest were the initiative of the Governor. Out of a total of 150 Raperda, only 38 Raperda (25%) have been stipulated as Perda, all of which are executive initiatives, there is no DPRD initiative. The process of forming Regional Regulations in DKI Jakarta Province is in accordance with Law Number 12 of 2011 concerning Formation of Legislation and Permendagri Number 80 of 2015 concerning Formation of Regional Legal Products which has been amended by Permendagri Number 120 of 2018 concerning Amendments to Permendagri Number 80 2015 concerning the Establishment of Regional Legal Products.
