Ringkasan Isi : Dalam Undang-Undang Nomor 13 tahun 2003 Tentang Ketenagakerjaan pada Pasal 59 diatur dengan jelas mengenai syarat pekerjaan yang boleh menjadi objek Perjanjian Kerja Waktu Tertentu (PKWT) namun pada prakteknya masih banyak perusahaan yang tidak menaatinya demikian juga para pekerja masih banyak yang belum mengerti tentang hak-hak sebagai pekerja yang dilindungi oleh undang-undang sehingga apabila terjadi pemutusan hubungan kerja, para pekerja tersebut tidak mendapatkan hak-hak yang seharusnya dia dapatkan. Putusan Kasasi No.1304 K/Pdt.Sus-PHI/2020 menarik untuk diteliti diharapkan dapat menjadi salah satu informasi bagi pekerja PKWT dalam memperjuangkan hak-hak sebagai Pekerja. Metode penelitian untuk penulisan skripsi ini adalah metode yuridis normative yaitu dengan cara meneliti bahan pustaka yang sudah ada yaitu berupa peraturan perundang undangan tentang ketenagakerjaan dan termasuk Putusan Kasasi No.1304 K/Pdt.Sus-PHI/2020. Hasil penelitian ini menunjukkan bahwa ada hak-hak Pekerja (Buruh) dalam pengahiran Hubungan Kerja (PHK) Waktu Tertentu apabila kontrak kerja tidak sesuai dengan Ketentuan Pasal 59 Undang-Undang Nomor 13 tahun 2003 Tentang Ketenagakerjaan. Hak-hak Pekerja (Buruh) dalam Pengahiran Hubungan Kerja (PHK)Waktu Tertentu tersebut dikuatkan oleh Putusan Kasasi No.1304 K/Pdt.Sus-PHI/2020./ A. Name : Manampin Rajagukguk B. NIM : 1840057001 C. Summary of contents: law number 13 of 2003 concerning manpower in article 59 clearly regulates the terms of work that may be the object of a specific time work agreement but in practice there are still many companies that do not comply with it as well as many workers. Who do not understand the rights as workers that are protected by law so that in the event of termination of employment, these workers do not get the rights they should get. The cassation decision no.1304 K/Pdt.Sus-PHI/2020 is interesting to study and is expected to be one of the information for workers in fighting for their rights as workers. The research method for writing this thesis is a normative juridical method, namely by examining existing library materials, namely in the form of legislation on employment and including the cassation decision no. 1304 K/Pdt.Sus-PHI/2020. The results of this study indicate that there are rights of workers (labourers) in the termination of employment relations for a certain time if the work contract is not in accordance with the provisions of article 59 of law number 13 of 2003 concerning manpower. The rights of workers (labourers) in termination of employment relations for a certain time are strengthened by cassation decision no. 1304 K?Pdt.Sus-PHI/2020.
