Abstract

Bagi Bangsa Indonesia tanah adalah karunia Tuhan Yang Maha Esa dan merupakan kekayaan nasional dimana hubungan antara bangsa Indonesia dengan tanah tak bisa dilepaskan dan bersifat abadi. Pentingnya tanah bagi kehidupan manusia, maka untuk mencegah suatu permasalahan tentang tanah diperlukan pengaturan hak atas tanah dan penggunaan tanah. Pendaftaran tanah di Indonesia diwajibkan bagi pemilik tanah. Pelaksanaan pendaftaran tanah akan mendapatkan sertifikat sebagai alat bukti yang kuat dan sah secara hukum. Semakin berkembangnya era digital, pendaftaran tanah di Indonesia dapat dilakukan secara digitalisasi. Metode penelitian yang digunakan penulis adalah penelitian yuridis-normatif atau disebut juga penelitian kepustakaan yaitu penelitian dilakukan dengan cara meneliti dengan bahan pustaka berupa peraturan perundang-undangan, buku-buku, jurnal hukum, pendapat pakar-pakar hukum, dan wawancara yang berkaitan dengan pokok permasalahan dalam penelitian ini. Hasil penelitian bahwa pendaftaran tanah pada Badan Pertanahan Nasional (BPN) Jakarta Selatan dimasa Covid-19 tidak seluruhnya dilaksanakan secara digitalisasi. Jaminan keamanan data digital bagi hak atas tanah masih perlu di tinjau dan di tingkatkan lagi mengingat sistem elektronik di Indonesia yang masih lemah karena masih rentan diubah, disadap, dan dipalsukan. Pembukrian data digital perlu dipertajam dan dibuat sinkronisasi hukum antara hukum pertanahan dengan hukum teknologi informasi dan hukum pidana untuk permasalahan pembuktian kepemilikan hak atas tanah. / For the Indonesian nation, the land is a gift of God Almighty and is a national wealth where the relationship between the Indonesian nation and the land cannot be released and is eternal. The importance of land for human life, so to prevent a problem about land requires the regulation of land rights and land use. Land registration in Indonesia is required for landowners. The implementation of land registration will get a certificate as a strong and legally valid evidence tool. The development of the digital era, land registration in Indonesia can be done digitally. The research method used by the author is juridical-normative research or also called literature research, namely research conducted by researching with literature materials in the form of laws and regulations, books, legal journals, opinions of legal experts, and interviews related to the subject matter in this study. The results of the research that land registration at the National Land Agency (BPN) of South Jakarta in the Covid-19 period was not entirely carried out digitally. Digital data security guarantees for land rights still need to be reviewed and improved again considering that electronic systems in Indonesia are still weak because they are still vulnerable to change, tapping, and falsified. The provision of digital data needs to be sharpened and made legal synchronization between land law and information technology law and criminal law for the issue of proving ownership of land rights.
