Abstract

Hak Cipta adalah hak eksklusif pencipta yang timbul secara otomatis berdasarkan prinsip deklaratif setelah suatu ciptaan diwujudkan dalam bentuk nyata tanpa mengurangi pembatasan sesuai dengan ketentuan peraturan perundang-undangan. Lagu dan/atau musik termasuk ke dalam salah satu bentuk dari sebuah ciptaan. Maka dari itu, setiap Pencipta berhak mendapatkan haknya atas segala karya yang diciptakan, salah satunya adalah dengan mendapatkan imbalan berupa royalti sebagai hak ekonomi pencipta. Penarikan, penghimpunan, dan pendistribusian royalti dilakukan oleh LMKN. Metode yang digunakan dalam penelitian ini merupakan penelitian hukum normatif yang didukung dengan penelitian empiris. Metode pendekatan yang digunakan adalah pendekatan perundang-undangan. Sumber hukum dari penelitian ini berasal dari bahan hukum primer, sekunder, dan tersier. Teknik pengumpulan data yang digunakan yaitu melalui teknik kepustakaan dan dengan wawancara. Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta dan Peraturan Pemerintah Nomor 56 Tahun 2021 tentang Pengelolaan Royalti Hak Cipta Lagu dan/atau Musik ada untuk memberikan perlindungan atas karya cipta musik dan/atau lagu, terutama yang dipergunakan secara komersial. Dewasa ini, telah banyak kafe yang beroperasi terutama di wilayah Jakarta. Namun, dari banyaknya kafe yang beroperasi, masih sedikit yang melakukan pembayaran royalti. Adanya peraturan yang berlaku seharusnya dapat memberikan perlindungan yang layak kepada Pencipta atas karya ciptaannya./ Copyright is the exclusive right of the creator that arises automatically based on declarative principles after a work is realized in a tangible form without reducing restrictions in accordance with the provisions of laws and regulations. Songs and/or music are included in one form of a work. Therefore, every Creator has the right to get his rights to all the works created, one of which is to get a reward in the form of royalties as the creator's economic right. Withdrawal, collection, and distribution of royalties is carried out by LMKN. The method used in this research is normative legal research which is supported by empirical research. The approach method used is the statutory approach. The legal sources of this research come from primary, secondary, and tertiary legal materials. Data collection techniques used are through library techniques and interviews. Law Number 28 of 2014 concerning Copyright and Government Regulation Number 56 of 2021 concerning Management of Song and/or Music Copyright Royalties exist to provide protection for music and/or song copyrighted works, especially those used commercially. Now on, there are many cafes operating, especially in the Jakarta area. However, of the many cafes that operate, only a few make royalty payments. The existence of applicable regulations should be able to provide proper protection to the Creator for his creation.
