Abstract
Pandemi COVID-19 yang terjadi di negara Indonesia mengakibatkan banyak perusahaan mengalami kerugian, sehingga harus melakukan Pemutusan Hubungan Kerja secara satu pihak. Kejadian tersebut tentunya menyebabkan permasalahan hukum yang baru karena perusahaan tidak dapat memenuhi kewajibannya dan pekerja tidak mendapatkan haknya yaitu pesangon. Rumusan masalah dalam skripsi ini adalah apakah perusahaan dapat melakukan PHK dengan alasan pandemi COVID-19 dan bagaimanakah pelaksanaan hak pesangon bagi pekerja yang di PHK dengan alasan keadaan memaksa (studi kasus No. 306/Pdt.Sus-PHI/2020/PN. Mdn). Penulisan penelitian ini menggunakan metode penelitian Yuridis Normatif, dengan pendekatan penelitian pendekatan perundang-undangan (Statute Aproach) dan putusan pengadilan (Case Approach). yang bersumber dari bahan hukum primer, sekunder, dan tersier, serta menggunakan teknik pengelolaan dan penarikan kesimpulan secara deduktif. Kesimpulan dari penelitian ini adalah perusahaan dapat melakukan PHK dengan alasan pandemi COVID-19 karena dianggap sebagai keadaan memaksa. Serta perusahaan harus membayarkan pesangon sesuai dengan Pasal 156 Undang-undang Ketenagakerjaan karena dalam putusan No. 306/Pdt.Sus-PHI/2020/PN.Mdn, hakim memutuskan untuk membayarkan pesangon kepada pihak pekerja./ Many companies in Indonesia have been affected by the COVID-19 pandemic. Several companies experienced losses, one of which was caused by the COVID-19 pandemic, so they had to terminate their employment on one side. This incident certainly caused new legal problems because the company could not fulfill its obligations and workers did not get their rights, namely severance pay. The formulation of the problem in this thesis is whether a company can do layoffs due to the COVID-19 pandemic and how to implement severance rights for employees who have been laid off due to a pandemic (case study No. 306/Pdt.Sus-PHI/2020/PN.Mdn). In writing this study, the normative juridical research method was used. With a research approach to court decisions (Case Approach) and a statutory approach (Statute Aproach), which are sourced from primary, secondary, and tertiary legal materials, then use management techniques and deductive conclusions. The conclusion of this study is that companies can lay off workers on the grounds of the COVID-19 pandemic because it is considered a compelling situation. And the company must pay severance pay in accordance with Article 156 of the Manpower Act because in the decision no. 306/Pdt.Sus-PHI/2020/PN.Mdn, the judge decided to pay severance pay to the workers.
