Abstract

Diterbitkannya Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja memberikan perubahaan dalam perizinan Investasi. Perubahan secara jelas terjadi pada Online Single Submission yang sudah menggunakan analisis risiko atau berbasis risiko, yang bertujuan untuk memberikan kemudahaan dalam menerbitkan izin usaha. Masalah yang diteliti dalam penulisan ini mengenai penerapan Online Single Submission dan efetivitasnya pasca Diterbitkannya Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja. Penelitian ini menggunakan jenis penelitian hukum normatif, dimana sumber penelitian didapat dari mengkaji data sekunder melalui studi kepustakaan seperti buku, jurnal dan perundang-undangan. Penerapan Online Single Submission pasca Undang-Undang Nomor 11 Tahun 2020 telah memiliki pembagian risiko yakni, risiko rendah, menengah rendah, menengah tinggi dan tinggi. Online Single Sumbmission Berbasis risiko juga telah memiliki standar perizinan berupa Norma Standar Prosedur dan Kriteria (NSPK). Online Single Submission berbasis risiko pengaturannya juga telah lebih efektive dibanding sebelum berlakunya Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja, dimana dapat terlihat dari adanya Pengurangan Pembatasan Pada Bidang Usaha Tertutup yang dahulu sebelum berlakunya Undang-Undang Nomor 11 Tahun 2020 Tentang Cipta Kerja terdapat 20 bidang usaha yang tidak dapat diusahakan, hingga saat ini hanya 6 bidang usaha yang tidak dapat diusahakan bagi penanam modal./ The issualce os Law Number 11 of 2020 about Job Creation. Provide changes in Investment licencing. Changes clearly occur in the Online Single Submission which already uses risk analysis or is is risk-based, which aims to provide convenience in issuing business licenses. The Problem that must be investigated in this writing is regarding the application of Online Single Submission and its effectiveness after the issuance of Law Number 11 of 2020 about Job Creation. This rearch uses normative legal research, where the research source is obtained from reviewing secondary data through literature studies such as books, journal an laws. The application of Online Single Submission after Law Number 11 of 2020 has had a risk division, namely, low risk, medium low, medium high and high. Risk-Based Online Single Submission also has licensing standards in the form of Standard Procedures and Criteria Norms (NSPK). Online Single Submission based on its regulation has also beeb more effective than before the enactment of Law Number 11 of 2020 about Job Creation, which can be seen from the reduction of Restriction on Closed Business Fields which prior to the enactment of Law Number 11 of 2020 about Job Job Creation there were 20 fields businesses that cannot be managed, so far there are only 6 business fields that cannot be cultivated for investors.
