Abstract

Penerbitan Pengukuhan/Endorsement Surat Laut dan Pas Besar dilaksanakan dengan tujuan untuk menjamin keselamatan dan keamanan pelayaran serta melaksanakan fungsi pengawasan terhadap kelaiklautan kapal yang berlayar dari dan ke pelabuhan atau daerah pedalaman yang berada di wilayah kerja atau Daerah Lingkungan Kerja (DLKr) dan Daerah Lingkungan Kepentingan DLKP kantor Kesyahbandaran dan Otoritas Pelabuhan. Maka dari itu penerbitan Standar Operasional Prosedur (SOP) untuk Pengukuhan/Endorsement Surat Laut dan Pas Besar, terdapat beberapa permasalahan yang signifikan yang dihadapi oleh Kantor Kesyahbandaran dan Otoritas Pelabuhan (KSOP). Proses pengukuhan atau endorsement sering kali melibatkan banyak dokumen dan persyaratan administratif yang rumit DAN jika tidak lengkap dapat mengakibatkan penundaan atau penolakan permohonan. Keterlambatan ini dapat disebabkan oleh banyak faktor, termasuk antrian permohonan yang tinggi atau kekurangan staf untuk melakukan pemeriksaan. Sumber daya manusia yang terbatas di KSOP dapat menghambat efisiensi pelayanan. Penelitian ini merupakan penelitian hukum normatif. Penelitian hukum yang dimaksud adalah penelitian yang dilakukan dengan cara meneliti kepustakaan atau data sekunder. Penelitian hukum normatif disebut juga penelitian hukum doktrinal. Pada penelitian hukum jenis ini, seringkali hukum dikonsepkan sebagai apa yang tertulis dalam peraturan perundang-undangan (law in book). Sebagai Kesimpulan, (1) Pengaturan mengenai penerbitan Surat Laut dan Pas Besar di Indonesia telah memiliki dasar hukum yang kuat dan komprehensif, baik dalam konteks nasional maupun internasional. Berdasarkan Undang-undang Nomor 66 Tahun 2024 Perubahan Ketiga atas Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran serta Peraturan Menteri Perhubungan Nomor PM 39 Tahun 2017 tentang Pendaftaran dan Kebangsaan Kapal, kedua dokumen tersebut berfungsi sebagai Surat Tanda Kebangsaan Kapal Indonesia yang menjadi bukti hukum atas status kebangsaan dan legalitas kapal untuk berlayar. (2) Kantor Kesyahbandaran dan Otoritas Pelabuhan (KSOP) memiliki peran strategis dalam menjamin keselamatan, keamanan, dan ketertiban pelayaran melalui penerapan fungsi hukum dan administrasi pelabuhan penerbitan. Endorsement Surat Laut dan Pas Besar tidak hanya berfungsi administratif, tetapi juga merupakan instrumen pengawasan negara terhadap kelaikan dan legalitas kapal untuk beroperasi. Kata Kunci : Endorsement, Surat Laut Dan Pas Besar, Kantor Kesyahbandaran Dan Otoritas. / The issuance of Sea Letters and Large Passports is carried out with the aim of ensuring the safety and security of shipping and performing a supervisory function over the seaworthiness of ships sailing to and from ports or inland areas located within the working area or Working Area (DLKr) and Area of Interest DLKP of the Harbour Master's Office and Port Authority. Therefore, the issuance of Standard Operating Procedures (SOP) for the Endorsement of Sea Letters and Large Passports has resulted in several significant problems faced by the Harbour Master's Office and Port Authority (KSOP). The confirmation or endorsement process often involves numerous documents and complex administrative requirements, and if these are incomplete, it can result in delays or rejection of applications. These delays can be caused by many factors, including a high volume of applications or a shortage of staff to carry out checks. Limited human resources at the KSOP can hamper the efficiency of services. This research is normative legal research. Legal research refers to research conducted by examining literature or secondary data. Normative legal research is also known as doctrinal legal research. In this type of legal research, law is often conceptualised as what is written in legislation (law in book). In conclusion, (1) The regulations concerning the issuance of Sea Letters and Large Passports in Indonesia have a strong and comprehensive legal basis, both in the national and international contexts. Based on Law No. 66 of 2024, the Third Amendment to Law No. 17 of 2008 concerning Shipping and Minister of Transportation Regulation No. PM 39 of 2017 concerning Ship Registration and Nationality, both documents serve as Indonesian Ship Nationality Certificates, which are legal proof of the nationality and legality of ships to sail. (2) The Harbour Master's Office and Port Authority (KSOP) has a strategic role in ensuring the safety, security and order of shipping through the implementation of legal and administrative functions of port issuance. The endorsement of the Certificate of Registry and the Large Ship Certificate not only serves an administrative function but also constitutes a state oversight instrument regarding the seaworthiness and legality of a vessel to operate.
