Abstract

Tindak pidana korupsi yang sering disertai dengan tindak pidana pencucian (TPPU) menunjukkan pola kejahatan berlapis yang dilakukan untuk mengaburkan asal usul harta hasil kejahatan. Kompleksitas tersebut menimbulkan pertanyaan bagaimana penegakan hukum dijalankan ketika satu pelaku melakukan beberapa tindak pidana yang berdiri sendiri. Penelitian ini merumuskan masalah utama yakni (1) Apakah penegakan hukum terhadap pelaku tindak pidana korupsi yang dibarengi tindak pidana pencucian uang dalam konteks concursus realis terhadap Putusan Nomor: 43/Pid.Sus-TPK/2022/PN.JKT.PST sudah memenuhi rasa keadilan ? dan (2) Bagaimana analisis terhadap pertimbangan dan putusan hakim dalam menjatuhkan sanksi pidana kepada pelaku tindak pidana korupsi dan tindak pidana pencucian uang dalam Putusan Nomor: 43/Pid.Sus-TPK/2022/PN.JKT.PST, berdasarkan filosofi kontruksi hukum berupa concursus realis?. Penelitian ini menggunakan metode yuridis normatif dengan menggabungkan pendekatan peraturan perundang-undangan, pendekatan kasus dan pendekatan konsep. Teori yang digunakan antara lain penegakan hukum, tujuan hukum, konsep concursus realis dalam hukum pidana. Bahan hukum yang dianalisis secara kualitatif untuk menguraikan kontruksi concursus realis dan penerapannya dalam putusan pengadilan. Hasil penelitian menunjukkan bahwa Putusan Nomor: 43/Pid.SusTpk/2022/PN.Jkt.Pst, vonis selama 5 (lima) tahun terhadap terdakwa dinilai belum memenuhi rasa keadilan karena tidak sebanding dengan tingkat kesalahan, dampak sosial, serta kerugian negara yang sangat besar dan seharusnya termasuk kategori pidana paling berat. Meskipun hakim menggunakan pertimbangan yuridis dan non yuridis, putusan ini belum sepenuhnya mengacu pada pedoman pemidanaan dalam PERMA Nomor 1 Tahun 2020, penelitian ini menegaskan perlu konsistensi penerapan concursus realis dan pedoman pemidanaan sebagai bagian dari pembaharuan hukum untuk memastikan proporsionalitas, kepastian hukum dan pemenuhan rasa keadilan dalam perkara tindak pidana korupsi dan TPPU. Kata Kunci : Korupsi, Concursus Realis, dan Pencucian Uang / Corruption crimes that are often accompanied by money laundering (TPPU) show a pattern of layered crimes committed for the lust of the origin of the proceeds of crime. The complexity raises the question of how law enforcement is carried out when one perpetrator commits several independent crimes. This study outlines that main problems, namely (1) Does law enforcement against perpetrators of corruption crimes in the context of concursus realis against decision Number 43/Pid.Sus-TPK/2022/PN.JKT.PST fulfill the sense of justice ? and (2) how is the analysis of the judge’s considerations and sentences in imposing sanctions on perpetrators of corruption and money laundering crimes in decision Number 43/Pid.Sus-TPK/2022/PN.JKT.PST, based on the philosophy of legal construction in the form of concursus realis? This research uses a normative juridical method, combining a statutory regulatory approach, a case approach, and a conceptual approach. The theories used include law enforcement, the purpose of law, and the concept of concursus realis in criminal law. The legal materials are analyzed qualitatively to describe the construction of concursus realis and its application in court decisions. The research results indicate that decision Number 43/Pid.SusTPK/2022/PN.Jkt.Pst, a five year sentence against the defendant, is deemed unjust because it is disproportionate to the level of culpability, the social impact, and the enormous state losses. It should be categorized ad the most severe crime. Although the judge used both legal and non legal considerations, this decision did not fully adhere to the sentencing guidelines in PERMA Nurmber 1 of 2020. This research emphasizes the need for consistent application of concursus realis and sentencing guidelines as part of legal reform to ensure proportionality, legal certainty and the fulfillment of a sense of justice in corruption and money laundering cases.
