Abstract

Korupsi merupakan salah satu permasalahan utama yang menghambat terwujudnya tujuan negara hukum dan pemerintahan yang bersih. Undang-Undang Nomor 19 Tahun 2019 tentang Perubahan Kedua atas Undang-Undang Nomor 30 Tahun 2002 tentang Komisi Pemberantasan Tindak Pidana Korupsi, terjadi sejumlah perubahan mendasar yang memengaruhi kedudukan, kewenangan, dan independensi KPK, antara lain pembentukan Dewan Pengawas, perubahan status pegawai KPK menjadi Aparatur Sipil Negara (ASN), serta penempatan KPK dalam rumpun kekuasaan eksekutif. Perubahan tersebut menimbulkan perdebatan mengenai kesesuaiannya dengan prinsip negara hukum sebagaimana diatur dalam Pasal 1 ayat (3) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945.Penelitian ini bertujuan untuk menganalisis implikasi prinsip negara hukum terhadap independensi Komisi Pemberantasan Korupsi pasca berlakunya Undang-Undang Nomor 19 Tahun 2019. Penelitian ini menggunakan metode penelitian hukum normatif. Sumber bahan hukum terdiri atas bahan hukum primer berupa peraturan perundang-undangan dan putusan Mahkamah Konstitusi, bahan hukum sekunder berupa buku, jurnal nasional dan internasional, serta bahan hukum tersier yang relevan. Analisis dilakukan secara kualitatif dengan menggunakan metode penafsiran hukum dan argumentasi hukum. Hasil penelitian menunjukkan bahwa independensi KPK merupakan manifestasi dari prinsip negara hukum, khususnya prinsip supremasi hukum, pembatasan kekuasaan, pemisahan kekuasaan, persamaan di hadapan hukum, dan jaminan penegakan hukum yang bebas dari intervensi. Berlakunya Undang-Undang Nomor 19 Tahun 2019 telah membawa implikasi terhadap independensi KPK melalui penguatan mekanisme pengawasan dan perubahan struktur kelembagaan yang berpotensi mengurangi ruang independensi dalam pelaksanaan fungsi pemberantasan korupsi. Pasca Undang-Undang Nomor 19 Tahun 2019 dinilai telah mengubah karakter KPK dari lembaga independen yang bersifat khusus menjadi lembaga yang lebih dekat dengan cabang kekuasaan eksekutif. Oleh karena itu, perlu jaminan hukum terhadap independensi KPK agar tetap sejalan dengan prinsip negara hukum dan tujuan pemberantasan korupsi yang efektif di Indonesia/Corruption is one of the main issues hindering the realization of the rule of law and clean governance. Law No. 19 of 2019 on the Second Amendment to Law No. 30 of 2002 on the Corruption Eradication Commission introduced a number of fundamental changes that affect the status, authority, and independence of the KPK, including the establishment of a Supervisory Board, the change in the status of KPK employees to Civil Servants (ASN), and the placement of the KPK within the executive branch. These changes have sparked debate regarding their compatibility with the principle of the rule of law as stipulated in Article 1, paragraph (3) of the 1945 Constitution of the Republic of Indonesia. This study aims to analyze the implications of the principle of the rule of law on the independence of the Corruption Eradication Commission following the enactment of Law No. 19 of 2019. This study employs a normative legal research method. The legal sources consist of primary legal materials, such as legislation and Constitutional Court decisions; secondary legal materials, such as books and national and international journals; and relevant tertiary legal materials. The analysis was conducted qualitatively using legal interpretation and legal argumentation methods. The research findings indicate that the KPK’s independence is a manifestation of the principles of the rule of law, particularly the principles of the supremacy of law, the limitation of power, the separation of powers, equality before the law, and the guarantee of law enforcement free from interference. The enactment of Law No. 19 of 2019 has had implications for the KPK’s independence through the strengthening of oversight mechanisms and changes to its institutional structure, which have the potential to reduce the scope of independence in carrying out its anti-corruption functions. Following the enactment of Law No. 19 of 2019, the KPK is viewed as having shifted from an independent specialized agency to an institution more closely aligned with the executive branch. Therefore, legal safeguards for the KPK’s independence are necessary to ensure it remains consistent with the principles of the rule of law and the goal of effective anti-corruption efforts in Indonesia.
