Abstract

Kesalahpahaman dalam mengartikan suatu jabatan di perusahaan dapat menimbulkan konflik atau perselisihan yang berujung pada tuntutan atas hak-hak dari setiap unsur di dalam nya. Rumusan masalah dalam skripsi ini adalah apakah Dewan Komisaris dapat dikategorikan sebagai seorang Pekerja/Buruh dan bila pengakhiran hubungan kerja yang disebabkan karena meninggal dunia, apakah Dewan Komisaris bisa mendapatkan pesangon. Penelitian ini menggunakan metodologi penelitian hukum normatif, yang merupakan jenis penelitian kepustakaan dengan pendekatan perundang-undangan dan penerapan teknik pengumpulan data. Sumber data utama melibatkan data sekunder dari bahan hukum primer seperti Undang-Undang Dasar Negara Kesatuan Republik Indonesia Tahun 1945, Undang-Undang Nomor 13 Tahun 2003 Tentang Ketenagakerjaan, Undang-Undang Nomor 40 Tahun 2007 tentang Perseroan Terbatas, Undang-Undang Nomor 2 Tahun 2004 tentang Perselisihan Hubungan Industria, dan Undang-Undang Nomor 6 Tahun 2023 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 tentang Cipta Kerja menjadi Undang-Undang. Selain itu, bahan hukum sekunder diperoleh dari berbagai buku dan literatur, sementara bahan hukum tertier berupa kamus. Seluruh materi hukum ini dikumpulkan, disusun, dan dianalisis dalam rangka penelitian ini. Hasil dari penelitian ini dapat disimpulkan bahwa perselisihan hubungan industrial atas hak pesangon bagi Dewan Komisaris wajib melewati proses Bipartit, karna ajuran dari Sudisnaker tidak dapat disebut risalah penyelesaian. Pengadilan menggunakan kompetensi absolut dalam kasus ini karena Penggugat tidak mempunyai hubungan kerja dengan Tergugat sehingga disarankan untuk membawa ke Pengadilan Negeri. / A misinterpretation of a position within a company can result in conflicts or disputes, giving rise to claims regarding the entitlements of each party involved. The problem addressed in this thesis revolves around the categorization of the Board of Commissioners as either a Worker/Laborer and, in the event of employment termination due to death, whether the Board of Commissioners is eligible for severance pay. The author employs normative legal research as the research methodology, a form of literature study that adopts a legislative approach and utilizes data collection techniques. The data utilized consists of secondary data, specifically primary legal materials such as The Constitution of the Unitary State of the Republic of Indonesia of 1945, Law Number 13 of 2003 concerning Manpower, Law Number 40 of 2007 concerning Limited Liability Companies, Law Number 2 of 2004 concerning Industrial Relations Disputes, and Law Number 6 of 2023 concerning the Stipulation of Government Regulations in Lieu of Law Number 2 of 2022 concerning Job Creation into Law. Additionally, secondary legal materials are derived from various books and literature, and tertiary legal materials, such as dictionaries, are also included. Subsequently, these legal materials are gathered, organized, and subjected to analysis. The study's findings suggest that disputes concerning severance rights for the Board of Commissioners in industrial relations must undergo a bipartite process. This is due to the fact that Sudisnaker's recommendation does not qualify as a formal minutes of settlement. In this case, the Court exercised absolute competence, given that the Plaintiff lacked an employment relationship with the Defendant. Therefore, it was deemed appropriate to bring the matter before the District Court.
