Abstract

Judul : Implikasi Hukum Dan Kebijakan Terhadap Perlindungan Pekerja Platform Digital Dalam Sistem Jaminan Sosial Nasional Transformasi ekonomi digital telah melahirkan bentuk hubungan kerja baru melalui platform digital yang menantang konstruksi hukum ketenagakerjaan dan sistem jaminan sosial konvensional. Pekerja platform digital bekerja dalam pola kerja yang fleksibel, berbasis algoritma, dan umumnya diklasifikasikan sebagai mitra usaha atau pekerja mandiri, bukan sebagai pekerja dalam hubungan kerja formal. Klasifikasi tersebut menimbulkan ketidakpastian status hukum yang berdampak langsung pada terbatasnya akses pekerja platform digital terhadap perlindungan jaminan sosial dalam Sistem Jaminan Sosial Nasional. Penelitian ini bertujuan untuk menganalisis status hukum pekerja platform digital dalam sistem ketenagakerjaan dan jaminan sosial di Indonesia serta mengkaji implikasi hukum dan kebijakan terhadap perlindungan jaminan sosial bagi pekerja platform digital. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, konseptual, dan pendekatan putusan pengadilan. Kerangka analisis penelitian didasarkan pada teori perlindungan hukum dan teori keadilan distributif untuk menilai sejauh mana regulasi dan kebijakan yang berlaku telah memberikan perlindungan hukum dan keadilan sosial bagi pekerja platform digital. Hasil penelitian menunjukkan bahwa ambiguitas status hukum, ketidaksinkronan antara hukum ketenagakerjaan dan jaminan sosial, serta desain kebijakan kepesertaan yang belum inklusif menyebabkan rendahnya tingkat kepesertaan pekerja platform digital dalam program jaminan sosial dan pembebanan risiko sosial secara tidak proporsional kepada pekerja. Kata Kunci: pekerja platform digital, jaminan sosial nasional, perlindungan hukum, keadilan distributif, ekonomi digital. / Title : Legal And Policy Implications On The Protection Of Digital Platform Workers In The Nastional Social Security System The transformation of the digital economy has generated new forms of work relationships through digital platforms that challenge the conventional legal framework of labour law and social security systems. Digital platform workers perform flexible, algorithm-based work and are generally classified as independent contractors or business partners rather than formal employees. This classification creates legal uncertainty regarding their employment status, which directly affects their access to social security protection within Indonesia’s National Social Security System. This research aims to analyze the legal status of digital platform workers in the Indonesian labour and social security system and to examine the legal and policy implications for their social security protection. This study employs a normative legal research method using statutory, conceptual, and judicial decision approaches. The analytical framework is grounded in the theory of legal protection and the theory of distributive justice to assess whether existing regulations and policies provide adequate legal protection and social justice for digital platform workers. The findings indicate that ambiguous legal status, regulatory inconsistencies between labour law and social security law, and non-inclusive participation policies have resulted in low social security coverage and the disproportionate allocation of social risks to digital platform workers.
