Abstract

Pada tahun 2023 lalu, Polda Metro Jaya menangkap sindikat peredaran obat palsu dan kedaluwarsa, yang artinya sudah banyak masyarakat secara tidak sadar dirugikan karena telah mengkonsumsi obat ilegal tersebut. Faktanya, masih banyak pelaku usaha yang mengabaikan aturan-aturan hukum dengan mengedarkan obat-obat ilegal hingga kadaluwarsa, demi mencapai keuntungan yang besar. Badan POM dan pemerintah seharusnya bersikap lebih tegas kepada para pelaku usaha, untuk mencegah para pelaku usaha yang jahat dan berdampak merugikan khalayak umum. Perlindungan hukum yang komprehensif bagi konsumen produk obat kemasan sangat penting untuk menjamin keselamatan dan kesejahteraan masyarakat umum. Fenomena ini menciptakan peluang untuk penyelidikan menyeluruh dan pemeriksaan yang ketat terhadap perlindungan hukum bagi konsumen. Dikarenakan sejatinya perlindungan adalah untuk melindungi dan bukan mencegah, maka skripsi ini akan membahas lebih lanjut sejauh mana pemerintah khususnya Badan POM dalam melindungi masyarakat akibat ulah pelaku usaha yang mengedarkan obat kadaluwarsa Penelitian yang dilakukan adalah penelitian hukum normatif dengan memanfaatkan data sekunder yang bersumber dari sumber kepustakaan. Metodologi penelitian yang digunakan meliputi pendekatan perundang-undangan dan pendekatan konseptual. Dalam penelitian ini digunakan Pendekatan Perundang-Undangan, yaitu suatu metode penelitian normatif yang mempertimbangkan semua peraturan perundang-undangan, termasuk yang secara khusus relevan dengan permasalahan hukum yang diteliti. Rumusan masalah dalam penelitian ini, yaitu mengenai Apakah kewajiban dan tanggung jawab pelaku usaha terhadap pengedaran obat kadaluwarsa dan Bagaimana perlindungan hukum bagi konsumen akibat perbuatan pelaku usaha dalam peredaran obat kadaluwarsa Hasil analisis dan penelitian menunjukkan bahwa tanggung jawab hukum dalam bidang perlindungan konsumen terhadap produk obat kemasan yang telah Kadaluwarsa dapat diwujudkan melalui ketentuan yang ditetapkan oleh Badan Pengawas Obat dan Makanan yang berkedudukan di bawah Badan Pengawas Perlindungan Konsumen khususnya di bidang obat. Peraturan Presiden Nomor 80 Tahun 2017 tentang Badan Pengawas Obat dan Makanan menjadi landasan hukum pembentukan badan ini. Tujuan utama lembaga ini adalah untuk membina dan mengoordinasikan penyeragaman pengawasan obat dan makanan sesuai dengan standar yang ditetapkan dalam Peraturan Presiden, khususnya pada Pasal 3. Meliputi penyusunan kebijakan nasional di bidang pengawasan obat dan makanan, penyusunan dan penetapan norma, standar, prosedur, dan kriteria pengawasan pra peredaran dan pasca peredaran, pelaksanaan pengawasan pra peredaran dan pasca peredaran, serta penetapan ketentuan teknis penetapan standar obat./ In 2023, Polda Metro Jaya arrested a syndicate distributing fake and expired drugs, which means that many people have unknowingly been harmed by consuming these illegal drugs. In fact, there are still many business actors who ignore legal regulations by distributing illegal drugs until they expire, in order to achieve great profits. The POM Agency and the government should take a firmer stance against business actors, to prevent evil business actors who have a detrimental impact on the general public. Comprehensive legal protection for consumers of packaged drug products is very important to ensure the safety and welfare of the general public. This phenomenon creates opportunities for thorough investigations and strict examinations of legal protection for consumers. Because protection is essentially to protect and not prevent, this thesis will discuss further the extent to which the government, especially the POM Agency, protects the public from the actions of business actors who distribute expired drugs. The research methodology employed encompasses both the statute approach and the conceptual approach. In this study, the Statute Approach is employed, which is a normative research method that considers all laws and regulations, including those specifically relevant to the legal issues under investigation. The formulation of the problem in this study is regarding what are the obligations and responsibilities of business actors regarding the distribution of expired drugs and what is the legal protection for consumers due to the actions of business actors in the distribution of expired drugs. The analysis and research findings indicate that legal responsibility in the realm of consumer protection for packaged food without an expiration date can be observed through the regulations set by the Food and Drug Supervisory Agency, which operates under the Consumer Protection Supervisory Agency in the food industry. Presidential Regulation Number 80 of 2017 on the Food and Drug Supervisory Agency provides the legal foundation for the creation of this entity. The primary objective of this institution is to establish and coordinate the uniformity of drug and food supervision in compliance with the standards outlined in the Presidential Regulation, particularly in Article 3. This includes the development of national policies pertaining to drug and food supervision, the formulation and establishment of norms, standards, procedures, and criteria for pre-circulation and post-circulation supervision, the execution of pre-circulation and post-circulation supervision, and the determination of technical provisions for determining food standards.
