Abstract
Penentuan status hukum konsumen yang juga bertindak sebagai mitra dalam platform e-commerce, sebagaimana terlihat pada kasus Shox Rumahan dalam Putusan No. 15/PDT.SUS-BPSK/2023/PN Grt, menimbulkan ketidakpastian karena belum diatur secara tegas dalam Undang-Undang Perlindungan Konsumen. Ketidakjelasan ini berpotensi melemahkan perlindungan hukum bagi konsumen sekaligus mitra yang terlibat dalam transaksi digital. Selain itu, ketidakhadiran pihak dalam pemeriksaan sengketa di BPSK dapat memengaruhi keadilan putusan, sehingga diperlukan penyempurnaan prosedur pemanggilan dan verifikasi kehadiran./The determination of the legal status of consumers who also act as partners in e-commerce platforms, as seen in the Shox Rumahan case in Decision No. 15/PDT.SUS-BPSK/2023/PN Grt, creates legal uncertainty because it is not explicitly regulated in the Consumer Protection Law. This ambiguity has the potential to weaken legal protection for consumers who simultaneously serve as platform partners in digital transactions. In addition, the absence of parties during dispute examinations at BPSK can affect the fairness of decisions, indicating the need for improved procedures for summons and attendance verification.
