Abstract

Kompleksitas persoalan hukum terkait hubungan kerja alih daya yang kerap memicu konflik antara perusahaan pengguna jasa alih daya, penyedia tenaga kerja, dan pekerja. Fokus penelitian diarahkan pada kajian perlindungan hukum bagi perusahaan pengguna jasa alih daya yang menghentikan kerja sama dengan perusahaan penyedia tenaga kerja. Kajian ini menjadi penting mengingat keberadaan regulasi dalam UU Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan UU Nomor 6 Tahun 2023 tentang Cipta Kerja. Jenis penelitian yang dipakai dalam penulisan ini memakai teori perlindungan hukum dan teori kepastian hukum, menggunakan metode penelitian yaitu penelitian yuridis normatif dengan pendekatan perundang-undangan dan pendekatan kasus, serta ditopang bersama data yang diperoleh dari data kepustakaan diantaranya buku-buku, peraturan perundang-undangan, serta putusan pengadilan. Berdasarkan hasil penelitian pada Studi Putusan MA Nomor 1103K/Pdt.Sus-PHI/2023 menunjukkan bahwa perusahaan pengguna jasa alih daya memiliki kewajiban hukum untuk memenuhi hak-hak pekerja sesuai perjanjian kerja dan peraturan yang berlaku. Saran yang diajukan adalah perlunya memperkuat regulasi terkait alih daya untuk mencegah celah tanggung jawab di antara para pihak, serta mengoptimalkan penyelesaian sengketa melalui mekanisme non-litigasi guna memberikan perlindungan hukum yang lebih adil. / The complexity of legal issues related to outsourcing work relationships often triggers conflicts between companies using outsourcing services, labor providers and workers. The focus of the research is directed at studying legal protection for companies using outsourcing services that stop collaborating with companies providing labor. This study is important considering the existence of regulations in Law Number 13 of 2003 concerning Employment and Law Number 6 of 2023 concerning Job Creation. The type of research used in this writing uses protection theory and legal certainty theory with research methods, namely normative juridical research with a statutory approach and case approach, and is supported by data obtained from library data including books, statutory regulations, and court ruling. Based on research results in the Supreme Court Decision Study Number 1103K/Pdt.Sus-PHI/2023, it shows that companies using outsourcing services have a legal obligation to fulfill workers' rights in accordance with work agreements and applicable regulations. The suggestion put forward is the need to strengthen regulations related to outsourcing to prevent gaps in responsibility between the parties, as well as optimizing dispute resolution through non-litigation mechanisms to provide fairer legal protection.
