Abstract

Pembajakan film dilakukan bukan cuman hanya melalui situs tidak resmi, tetapi saat ini pembajakan film juga dilakukan melalui media sosial yaitu Tiktok. Di Tiktok, tindakan bajakan dilakukan dengan mengunggah konten berupa potongan film pada aplikasi Tiktok tanpa ada izin dari pencipta film Tujuan dari penelitian ini untuk mengetahui perlindungan hukum bagi pencipta film terhadap penyebaran potongan film yang beredar pada aplikasi Tiktok dan untuk mengetahui juga tanggungjawab Tiktok sebagai platfrom yang menyediakan penyebaran potongan film pada aplikasi Tiktok Penelitian ini menggunakan metode penelitian hukum yuridis normatif dengan pendekatan perundang-undangan (Statue Approach). Penelitian ini menumukan adanya perlindungan hukum bagi pencipta film terhadap penyebaran potongan film yang beredar pada aplikasi Tiktok dalam bentuk preventif dan represif yang telah diupayakan melalui Undang-Undang Nomo28 Tahun 2014 Tentang Hak Cipta. Aplikasi Tiktok juga sudah melalukan upayanya dalam pelanggaran hak cipta film dalam Terms of Service and Community Guidelines Tiktok yang melarang pengunggahan konten yang melanggar hak cipta. / Movie piracy is carried out not only through unofficial sites, but currently movie piracy is also carried out through social media, namely Tiktok. In Tiktok, piracy is carried out by upload content in the form of movie cuts on the Tiktok application without permission from the film creator. The purpose of this study is to determine the legal protection for film creators against the distribution of film clips circulating on the Tiktok application and to determine also the responsibility of Tiktok as a platform that provides the distribution of film clips on the Tiktok application This study uses a normative juridical legal research method with a statutory approach (Statue Approach). This study found that there is legal protection for film creators against the distribution of film clips circulating on the Tiktok application in the form of preventive and repressive measures that have been pursued through Law No. 28 of 2014 concerning Copyright. The Tiktok application has also made efforts to violate film copyright in Tiktok's Terms of Service and Community Guidelines which prohibit uploading content that violates copyright.
