Abstract

PERLINDUNGAN HUKUM PERDAGANGAN EXPORT PRODUK PEMBERSIH LANTAI DI INDONESIA Perlindungan hukum dalam perdagangan internasional bertujuan menciptakan kepastian hukum dan rasa saling percaya antara pihak-pihak yang terlibat. Hal ini melibatkan pemahaman mendalam tentang aturan hukum negara mitra, perjanjian internasional, dan hukum internasional sebagai jalan tengah dalam menyelesaikan perbedaan hukum. Di Indonesia melalui Peraturan No. 24 Tahun 2000, telah mengintegrasikan perjanjian internasional ke dalam hukum nasional untuk melindungi eksportir sekaligus mendorong investasi dan perdagangan. Adapun rumusan masalah dalam penelitian ini yaitu apa saja faktor pendukung dan faktor penghambat perdagangan eksport produk pembersih lantai di Indonesia dan bagaimana peran pemerintah dalam mendukung implementasi peraturan perdangangan export di Indonesia. Jenis metode penelitian yang digunakan dalam penelitian ini adalah penelitian yuridis normatif yaitu pendekatan yang mengutamakan kajian terhadap peraturan perundang-undangan, dokumen resmi, serta teori-teori hukum yang relevan dengan permasalahan yang dibahas. Hasil penelitian ini menunjukkan bahwa Pertama, perusahaan harus beradaptasi untuk bersaing di pasar internasional dengan memanfaatkan perkembangan teknologi serta mempertimbangkan faktor regulasi, lokasi geografis, tenaga kerja lokal, kematangan pasar, dan kapasitas produksi. Kedua, hambatan ekspor dapat berasal dari faktor internal, seperti keterbatasan sumber daya, kemampuan pemasaran, dan akses informasi, serta faktor eksternal, seperti regulasi di negara tujuan dan lingkungan perdagangan internasional. Ketiga, pemerintah mendukung industri melalui UU Cipta Kerja dan PP Nomor 7 Tahun 2021 dengan memberikan insentif kepabeanan, kemudahan impor bahan baku, fasilitas ekspor, serta mendorong kemitraan UMKM dengan usaha besar untuk meningkatkan daya saing dan kompetensi. Kata Kunci: Perlindungan Hukum, Perdagangan Ekspor, Produk pembersih Lantai / LEGAL PROTECTION FOR EXPORT TRADE OF CLEANING PRODUCTS IN INDONESIA Legal protection in international trade aims to create legal certainty and mutual trust between the parties involved. This involves a deep understanding of the legal rules of partner countries, international agreements, and international law as a middle ground in resolving legal differences. In Indonesia, through Regulation No. 24 of 2000, international agreements have been integrated into national law to protect exporters while encouraging investment and trade. The formulation of the problem in this study is what are the supporting factors and inhibiting factors for export trade in cleaning products in Indonesia and what is the role of the government in supporting the implementation of export trade regulations in Indonesia. The type of research method used in this study is normative legal research, namely an approach that prioritizes the study of laws and regulations, official documents, and legal theories that are relevant to the problems discussed. The results of this study indicate that First, companies must adapt to compete in the international market by utilizing technological developments and considering regulatory factors, geographic location, local labor, market maturity, and production capacity. Second, export barriers can come from internal factors, such as limited resources, marketing capabilities, and access to information, as well as external factors, such as regulations in the destination country and the international trade environment. Third, the government supports industry through the Job Creation Law and PP Number 7 of 2021 by providing customs incentives, ease of importing raw materials, export facilities, and encouraging partnerships between MSMEs and large businesses to increase competitiveness and competence.
