Abstract

Penelitian ini bertujuan untuk menganalisis kepastian hukum rumah sakit dalam memberikan pelayanan kesehatan kepada anak terlantar tanpa Nomor Induk Kependudukan (NIK) yang menggunakan BPJS Kesehatan. Berdasarkan UUD 1945, jaminan kesehatan adalah hak seluruh rakyat, termasuk anak terlantar yang tidak memiliki identitas resmi. Namun, aturan teknis seperti Peraturan Presiden Nomor 111 Tahun 2013 dan Peraturan Pemerintah Nomor 101 Tahun 2012 tentang Penerima Bantuan Iuran (PBI) BPJS belum secara spesifik mengatur perlindungan anak terlantar tanpa NIK. Akibatnya, terdapat kekosongan hukum yang berdampak pada tidak terpenuhinya hak kesehatan anak-anak ini. Penelitian menggunakan metode yuridis normatif dengan pendekatan konseptual dan peraturan perundang-undangan. Dengan analisa teori kepastian hukum dan perlindungan hukum dari Gustav radburch dan Philippus Hadjon, Hasil penelitian menunjukkan adanya kekosongan hukum pada level pelaksanaan. Dan belum lengkapnya prosedur pelaksanaan pelayanan kesehatan anak terlantar tanpa NIK. Saran dari Peneliti adalah Negara hadir dalam menyediakan rangkaian norma dan peraturan turunan dari Amanat UUD 1945 lex specialis derogat legi generali dengan melibatkan seluruh pembuat UUD dan lapisan masyarakat. Sebagai langkah perlindungan Hukum bagi RS Swasta selain dalam peraturan perlu adanya standar prosedur operasional atau alur proses yang di tetapkan dalam proses pelayanan kesehatan anak terlantar tanpa NIK. / This research aims to analyze the legal certainty of hospitals in providing health services to neglected children without a Population Identification Number (NIK) using BPJS Health. Based on the 1945 Constitution of the Republic of Indonesia, health insurance is the right of all people, including abandoned children who do not have an official identity. However, technical regulations such as Presidential Regulation Number 111 of 2013 and Government Regulation Number 101 of 2012 concerning BPJS Contribution Assistance (PBI) Recipients do not specifically regulate the protection of abandoned children without NIK. As a result, there is a legal vacuum which results in children's health rights not being fulfilled. The research uses normative juridical methods with a conceptual approach and statutory regulations. By analyzing the theory of legal certainty and legal protection from Gustav Radburch and Philippus Hadjon, the research results show that there is a legal vacuum at the implementation level. And the procedures for implementing health services for abandoned children without a NIK are incomplete. The researcher's suggestion is that the State is present in providing a series of norms and regulations derived from the 1945 Constitution's mandate lex specialis derogat legi generali by involving all Constitution makers and levels of society. As a legal protection step for private hospitals, apart from regulations, there needs to be standard operational procedures or process flows that are established in the process of providing health services to neglected children without NIK.
