Abstract
UU Ketenagakerjaan No. 13 Tahun 2003 mengatur sebuah pengamanan hukum bagi pekerja kontrak. Tujuan dari klausul ini ialah untuk menjamin bahwa tugas dan hak pekerja kontrak cukup dilindungi. Salah satu poin utama yang menjadi perdebatan adalah jenis perlindungan hukum yang diberikan oleh UU No. 13 Tahun 2003 tentang Ketenagakerjaan kepada pekerja kontrak, serta evaluasi terhadap ketentuan tersebut dalam hal kepastian dan kesetaraan hukum. Undang-Undang Ketenagakerjaan No. 13 Tahun 2003 telah berhasil menerapkan hak hukum baik sebelum maupun sesudah putusan MK No. 100 PUU-W 2012. Selain itu, studi pada pekerja dan karyawan yang disubkontrakkan menunjukkan bahwa perlindungan yang ditawarkan memadai, efektif, dan ideal. Kepastian hukum dalam perlindungan preventif dan kepastian hukum dalam perlindungan represif adalah dua komponen penting yang dapat diakui ketika menganalisis hal ini melalui prisma Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan untuk memahami perlindungan hukum bagi pekerja outsourcing. Kepastian hukum perlindungan pencegahan mencakup jaminan hubungan kerja, yang berkaitan dengan jenis hubungan yang ada antara perusahaan outsourcing dan karyawan yang mereka pekerjakan, serta harapan yang dibuat oleh pemberi kerja. Penjelasan ini menguraikan jenis pekerjaan yang didelegasikan kepada karyawan yang dialihdayakan serta kedudukan hukum perusahaan outsourcing./Manpower Law No. 13 of 2003 regulates a legal security for contract workers. The purpose of this clause is to ensure that the duties and rights of contract workers are adequately protected. One of the main points of contention is the type of legal protections that Law No. 13 of 2003 regarding Manpower affords to contract workers, as well as an evaluation of these provisions in terms of legal certainty and equality. Employment Law No. 13 of 2003 has successfully implemented legal rights both before and after the Constitutional Court's decision No. 100 PUU-W 2012. Furthermore, studies on subcontracted workers and employees show that the safeguards offered are adequate, effective, and ideal. Legal certainty in preventative protection and legal certainty in repressive protection are two crucial components that can be recognized when analyzing this via the prism of Law No. 13 of 2003 about Employment in order to understand the legal protections for outsourced workers. Preventative protection's legal certainty includes the guarantee of employment relationships, which deals with the type of relationship that exists between outsourcing firms and the employees they hire, as well as the expectations that employers make. This explanation outlines the kinds of work that are delegated to employees who are outsourced as well as the legal standing of outsourcing companies.
