Abstract

Konflik.yang.terjadi.di.wilayah.Timur.Tengah, khususnya antara Palestina.dan.Israel, telah mempengaruhi berbagai aspek kemanusiaan dan mengancam keamanan manusia. Penelitian yang berjudul “Analisis Penyebab Ketidakefektifan Resolusi.Dewan.Keamanan.PBB No.2712/2023 Dalam .Penyelesaian.Konflik.Palestina-Israel” bertujuan untuk menggali secara mendalam faktor-faktor yang menyebabkan ketidakefektifan resolusi Dewan Keamanan PBB No.2712/2023. Penelitian ini menggunakan konsep legalisasi dan kepentingan nasional. Metode yang digunakan adalah metode kualitatif dengan pendekatan studi kasus dan jenis penelitian deskriptif-analitis..Teknik pengumpulan.data.dilakukan melalui data primer dan data sekunder. Data Primer bersumber dari Statement SEKJEN PBB dan wakil tetap anggota negara PBB dalam konferensi Pers di New York dalam siaran langsung resmi di Youtobe United Nation. Data Sekunder bersumber.dari.literatur seperti buku, jurnal. ilmiah,.artikel, dan.situs web resmi (United Nations,Un Charter,KEMLU). Upaya yang telah dilakukan Dewan Keamanan PBB adalah mengeluarkan resolusi No.2712/2023.tentang.“Urgent.and.Extended.Humanitarian.Pauses.and.Corridors.Throughout.the.Gaza.Strip” pada 15 November 2023. Resolusi ini bertujuan untuk merespons situasi kemanusiaan yang kritis di Jalur Gaza terkait pelanggaran hukum dan HAM, khususnya di wilayah Palestina-Israel. Dalam.menyelesaikan. sengketa.internasional, DK-PBB mengeluarkan.suatu.keputusan.sebagai.solusi penyelesaian konflik Palestina-Israel yaitu.melalui.resolusi-resolusinya. Resolusi DK-PBB ini anggap mampu menyelesaikan konflik berkepanjangan antara Palestina dan Israel. Hasil.penelitian.menunjukan bahwa DK-PBB memiliki.peran sebagai.pihak yang.bertanggung.jawab sekaligus mediator dalam menangani konflik antara Palestina-Israel. Akan tetapi, dalam praktiknya, resolusi DK-PBB kerap kali disalahgunakan oleh negara-negara anggota tetap untuk mencapai tujuan politik tertentu. Konflik ini mencerminkan adanya kepentingan nasional dari Palestina, Israel, dan Amerika Serikat, serta ketidaksempurnaan dalam penerapan kewajiban, ketepatan, dan delegasi terhadap rancangan resolusi DK-PBB No.2712/2023. Kepentingan nasional Palestina dan Israel lebih cenderung pada aspek ekonomi dan politik, sehingga resolusi DK-PBB No.2712/2023 dinilai tidak efektif dalam menyelesaikan konflik Palestina-Israel. Amerika Serikat juga menggunakan hak vetonya untuk melindungi kepentingan nasionalnya terhadap Israel. Stabilitas keamanan dan perdamaian internasional masih jauh dari cita-cita dan tujuan didirikannya PBB. Hal inilah yang menjadi alasan mengapa resolusi Dewan Keamanan PBB No.2712/2023 dinilai tidak efektif dalam menyelesaikan konflik Palestina-Israel. Kata Kunci: Palestina-Israel; Resolusi DK-PBB No. 2712/2023; AS; Kepentingan Nasional. / Conflicts that occur in the Middle East region, especially between Palestine and Israel, have affected various aspects of humanity and threaten human security. The research entitled ‘The Causes of the Ineffectiveness of UN Security Council Resolution No.2712/2023 in Resolving the Palestinian-Israeli Conflict’ aims to explore in depth the factors that cause the ineffectiveness of UN Security Council resolution No. 2712/2023. This research uses the concepts of legalisation and national interest. The method used is a qualitative method with a case study approach and descriptive-analytical research type. Data collection techniques are carried out through primary data and secondary data. Primary data is sourced from the UN Secretary General's Statement and permanent representatives of UN member states in a press conference in New York in an official live broadcast on Youtobe United Nation. Secondary data is sourced from literature such as books, scientific journals, articles, and official websites (United Nations, UN Charter, KEMLU). The efforts that have been made by the UN Security Council are to issue Resolution No. 2712/2023 on ‘Urgent and Extended Humanitarian Pauses and Corridors Throughout the Gaza Strip’ on 15 November 2023. This resolution aims to respond to the critical humanitarian situation in the Gaza Strip related to violations of law and human rights, especially in the Palestinian-Israeli territories. In resolving international disputes, the UNSC issued a decision as a solution to resolve the Palestinian-Israeli conflict through its resolutions. The UNSC resolution is considered capable of resolving the prolonged conflict between Palestine and Israel. The results showed that the role of the UNSC Resolution as a responsible party as well as a mediator in handling the Palestinian-Israeli conflict. But in recent conditions, the existence of the UNSC resolution is often misused by large countries that are included in the permanent members of the UNSC. This conflict reflects the national interests of Palestine, Israel, and the United States, as well as imperfections in the application of obligations, accuracy, and delegation to the draft UNSC Resolution No.2712/2023. The national interests of Palestine and Israel are more likely to be in the economic and political aspects, so that UNSC Resolution No.2712/2023 is considered ineffective in resolving the Palestinian-Israeli conflict. The United States also uses its veto right to protect its national interests against Israel. Security stability and international peace are still far from the ideals and goals of the UN. This is the reason why UN Security Council Resolution No.2712/2023 is considered ineffective in resolving the Palestinian-Israeli conflict.
