Abstract

Untuk memahami secara mendalam, bahwa Perlindungan Hukum Aspek Pengupahan adalah memastikan upah beserta tunjangan yang diberikan sesuai standar kelayakan dan apabila tidak dilaksanakan memiliki sanksi administrative sebagaimana dimaksud dalam Peraturan Pemerintah No 78 Tahun 2015 tentang Pengupahan. Penelitian tentang Perlindungan Hukum Aspek Pengupahan Pekerja Pasca di Terbitkannya Peraturan Pemerintah No 78 Tahun 2015 tentang Pengupahan, merupakan penelitian empiris, hukum normatif dan bersifat deskriptif dengan pendekatan yuridis normatif, kegunaan penelitian ini ditujukan untuk mengkaji peraturan-peraturan tertulis atau bahan-bahan hukum lainnya yang berkenaan dengan standar upah yang layak untuk para pekerja berdasarkan PP No. 78 Tahun 2015 serta bagaimana perlindungan hukum terhadap pekerja untuk memperoleh upah yang layak tersebut berdasarkan PP No.78 Tahun 2015 dan melakukan perbandingan standar penentuan upah yang layak berdasarkan Undang-Undang (UU) No. 13 tahun 2003 tentang Ketenagakerjaan dan PP No.78 Tahun 2015. Dalam pelaksanaannya tetap dibutuhkan data primer untuk mendukung data sekunder. Perlindungan Hukum Aspek Pengupahan Pekerja sesuai PP No.78/2015 menjamin penghasilan yang layak diterima pekerja merupakan pendapatan Pekerja yang mampu memenuhi kebutuhan hidup Pekerja dan keluarganya secara wajar. Kata Kunci : Perlindungan Hukum, Pengupahan Pekerja, Penghasilan Yang Layak. / To understand in depth, that aspect of Remuneration Protection Law is to ensure that wage and allowances given in accordance eligibility standards and, if not implemented have administrative sanctions as stipulated in Government Regulation No. 78 Year 2015 on Remuneration. Research on Legal Protection Aspects of Worker Remuneration post-issuance of Government Regulation No. 78 Year 2015 on Remuneration, are an empirical research, legal normative and descriptive with normative juridical approach. The usefulness of this study seeks to examine the written rules materials or other law relating with a worker decent wage under Government Regulation No. 78 Year 2015 and how the legal protection for workers to earn a decent wage based on Government Regulation No.78 Year 2015 and make comparison on standard of determining the decent wages under the Law No. 13 Year 2003 on Manpower and Government Regulation No.78 Year 2015. In the implementation, the research still need the primary data to support the secondary data. Legal Protection Aspects of Worker Remuneration in Government Regulation No. 78 Year 2015 guarantee a decent income is the income received by workers that are able to meet worker's needs of living and their families fairly.
