Abstract

ABSTRAK PERLINDUNGAN HUKUM TERHADAP TERTANGGUNG DALAM BENTUK PENOLAKAN KLAIM POLIS ASURANSI YANG TELAH DIBERIKAN KE OTORITAS JASA KEUANGAN Perusahaan asuransi menanggung pertanggungan selama pengangkutan dari pelabuhan hingga ke tempat tujuan, penelitian ini bertujuan untuk memahami dan menganalisis upaya dan hambatan Otoritas Jasa Keuangan terhadap penyelesaian sengketa tentang penolakan klaim polis asuransi, mengkaji dan menganalisa tentang kewenangan Otoritas Jasa Keuangan dalam perlindungan hukum terhadap tertanggung dalam penolakan klaim polis asuransi. Teori yang digunakan ialah Teori keadilan, teori perlindungan hukum dan teori pertanggungjawaban hukum. Metode yang diterapkan dalah kajian metode penelitian yuridis normatif. Pendekatan penelitian yang digunakan dalam penelitian ini Pendekatan Undang-Undang (Statue Approach) dan Pendekatan analitis (Analytical Approach), menggunakan deskriptif analisis secara kualitatif dengan teknik deskriptif analisis secara kualitatif ini mengelola keseluruhan data yang terkumpul baik dan dianalisis dengan cara menyusun data secara sistematis, digolongkan dalam pola dan tema, dikategorisasikan dan diklasifikasikan. Hasil Penelitian upaya pemberian perlindungan hukum terhadap tertanggung khususnya dalam penolak klaim polis asuransi yang diajukan ke Otoritas Jasa keuangan. Otoritas Jasa Keuangan dalam melakukan prinsip – prinsip pelaksanaannya, antara lain: Prinsip Transparansi, Prinsip Perlakuan yang adil, Prinsip Keadilan, Prinsip Kerahasiaan dan Keamanan Data, Prinsip Penanganan Pengaduan dan Hambatan yang dihadapi adalah Kendala Internal, meliputi Pengaduan yang disampaikan nasabah kurang jelas dan Bukti pengaduan berupa dokumen pendukung yang disampaikan kurang lengkap, kendala Eksternal, yaitu: Kurangnya Informasi yang didapat dan Kurangnya pemahaman Tertanggung terhadap produk-produk asuransi yang ingin dilakukan. Serta, Otoritas Jasa Keuangan berfungsi menyelenggarakan sistem pengaturan dan pengawasan terintegrasi terhadap keseluruhan kegiatan dalam sektor jasa keuangan di Indonesia. Kesimpulan: kewenangan Otoritas Jasa Keuangan dalam memberikan perlindungan hukum terhadap Tertanggung dalam penolakan klaim asuransi asuransi, yaitu dengan memberikan perlindungan hukum preventif dan represif. Kata Kunci: Penolakan klaim, Perusahaan Asuransi dan Otoritas Jasa Keuangan. / ABSTRACT LEGAL PROTECTION AGAINST THE INSURED IN THE FORM OF REJECTION OF INSURANCE POLICY CLAIMS THAT HAVE BEEN PROVIDED TO THE FINANCIAL SERVICES AUTHORITY Insurance companies cover insurance during transportation from the port to the destination. This research aims to understand and analyze the efforts and obstacles of the Financial Services Authority in resolving disputes regarding rejection of insurance policy claims, reviewing and analyzing the authority of the Financial Services Authority in legal protection of insureds in rejections. Insurance policy claim. The theories used are the theory of justice, the theory of legal protection and the theory of legal responsibility. The method applied is a study of normative juridical research methods. The research approach used in this research is the Statute Approach and the Analytical Approach, using qualitative descriptive analysis with qualitative descriptive analysis techniques, managing the entire data collected well and analyzed by arranging the data systematically, classified into patterns and themes, categorized and classified. Research results on efforts to provide legal protection to the insured, especially in rejecting insurance policy claims submitted to the Financial Services Authority. The Financial Services Authority in implementing its implementation principles, among others: Transparency Principles, Fair Treatment Principles, Fairness Principles, Data Confidentiality and Security Principles, Complaint Handling Principles and Obstacles faced are Internal Obstacles, including Complaints submitted by customers that are unclear and Evidence Complaints in the form of incomplete supporting documents submitted, external obstacles, namely: lack of information obtained and lack of understanding of the insured regarding the insurance products they wish to use. Also, the Financial Services Authority functions to organize an integrated regulatory and supervisory system for all activities in the financial services sector in Indonesia. Conclusion: the authority of the Financial Services Authority to provide legal protection to the Insured in the rejection of insurance claims, namely by providing preventive and repressive legal protection.
