Abstract

Judul Tesis: Konstruksi Perjanjian Kerja Outsourcing dalam Perlindungan Hukum Ketenagakerjaan di Indonesia. Kata Kunci: Perjanjian Kerja, Outsourcing, Perlindungan Hukum Ketenagakerjaan. Alih daya atau lebih dikenal sebagai outsourcing, merupakan pemindahan pekerjaan dari perusahaan penyerah pekerjaan (principal) kepada perusahaan penerima pekerjaan (vendor). Alih daya dimanfaatkan untuk meminimalisir biaya produksi atau memusatkan fokus kepada hal utama perusahaan. Namun, pelaksanaan alih daya seringkali tidak menguntungkan pekerja alih daya karena minimnya perlindungan hukum dalam hubungan kerja. Metode Penelitian yang digunakan adalah Yuridis Normatif, dengan analisis kualitatif logis normatif berdasarkan kedalaman data yang terhimpun secara menyeluruh, sistematis, kritis, dan konstruktif dalam sistem hukum ketenagakerjaan. Peran perjanjian kerja alih daya sangat penting dalam mengatur hubungan kerja, pelaksanaan pekerjaan alih daya, dan terutama perlindungan hukum bagi pekerja alih daya Mengingat berlakunya Undang-Undang Cipta Kerja meniadakan beberapa ketentuan terkait bentuk dan pembatasan jenis pekerjaan alih daya, yang berpotensi menimbulkan ketidakpastian. Oleh karena itu, diperlukan konstruksi perjanjian kerja yang setidaknya secara jelas dan rinci mengatur rua ng lingkup dan jangka waktu pekerjaan alih daya, serta pelaksanaan pelindungan pekerja, upah, kesejahteraan, syarat kerja, dan perselisihan yang timbul. / Thesis Title: Construction of Outsourcing Work Agreements on Employment Legal Protection in Indonesia. Keywords: Employment Agreement, Outsourcing, Employment Law Protection. ‘Alih daya’ or better known as outsourcing, is the transfer of work from the company giving the work (principal) to the company receiving the work (vendor). Outsourcing is used to minimize production costs or centering focus on the company's main things. However, the implementation of outsourcing often does not benefit outsourced workers because of the lack of legal protection in employment relationships. The research method used is Normative Juridical, with normative logical qualitative analysis based on the depth of data collected in a comprehensive, systematic, critical, and constructive manner in the employment law system. The role of outsourcing work agreements is very important in regulating employment relations, implementation of outsourced work, and especially legal protection for outsourced workers. Considering that the enactment of the Job Creation Law eliminates several provisions regarding forms and restrictions on types of outsourced work, which has the potential to create uncertainty. Therefore, it is necessary to construct a work agreement that at least clearly and in detail regulates the scope and duration of the outsourcing work, as well as the implementation of worker protection, wages, welfare, work conditions, and disputes that arise.
