Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap pekerja waktu tertentu yang mengalami penahanan ijazah oleh perusahaan, dengan fokus pada studi kasus Putusan Nomor 13/Pdt.SusPHI/2019/PN Tte. Permasalahan utama yang dikaji melibatkan aspek aspek hukum yang terkait dengan penahanan ijazah, hak-hak pekerja, dan keadilan dalam hubungan ketenagakerjaan. Jenis penelitian yang dipakai dalam penulisan ini yaitu penelitian yuridis normatif dengan metode pendekatan perundang-undangan (statute approach), dan Pendekatan Kasus (Case Approach) Berdasarkan hasil penelitian dapat disimpulkan bahwa tindakan penahanan ijazah oleh perusahaan terhadap pekerja dengan status waktu tertentu berpotensi menciptakan ketidaksetaraan hak dan memberikan kerugian pada pekerja tersebut. Keputusan Pengadilan Hubungan Industrial menegaskan bahwa penahanan ijazah harus memiliki dasar yang jelas dan sah. Impilikasi praktis dari temuan ini menunjukkan pentingnya perbaikan regulasi dan pemahaman yang lebih mendalam mengenai hak hak pekerja dalam konteks ketenagakerjaan. Hasil penelitian ini diharapkan dapat memberikan sumbangan dalam pengembangan kebijakan perlindungan hukum bagi pekerja dengan status waktu tertentu, sekaligus meningkatkan pemahaman terhadap isu-isu ketenagakerjaan di Indonesia. Kata Kunci : Perlindungan Hukum, Penahanan Ijazah, Pekerja Waktu Tertentu. / This research aims to analyze the legal protection afforded to fixed-term employees who experience the withholding of academic certificates by companies, with a focus on the case study of Decision Number 13/Pdt.Sus PHI/2019/PN Tte. The main issues investigated involve legal aspects related to the withholding of academic certificates, employee rights, and justice in employment relations. The research methodology employed in this study is normative juridical research with a statutory approach and a casel approach. Based on the research findings, it can be concluded that the act of withholding academic certificates by companies against fixed-term employees has the potential to create inequality of rights and cause harm to the employees. The Industrial Relations Court's decision emphasizes that the withholding of academic certificates must have a clear and valid basis.
