Abstract

DKI Jakarta mengalami kekosongan jabatan wakil gubernur lebih dari 1 (satu) tahun sejak Sandiaga Salahudin Uno sebagai wakil gubernur periode 2017-2022 mengundurkan diri. Mekanisme pengisian kekosongan tersebut sebenarnya telah diatur dalam UU Pilkada dan UU Pemda, namun dalam pelaksanaannya banyak mengalami kendala schingga memperlamban proses pengisian kekosongan. Kekosongan jabatan tersehut juga tentu saja memiliki sebab dan akibat hukum yang akan dialami oleh masyarakat maupun Pemerintan Provinsi DKI Jakarta. Metode penelitian yang digunakan adalah metode penelitian yuridis normatif dengan pendekatan perundang-undangan. dimana penulis menganalisis dan menggambarkan mekanisme pengisian kekosongan jabatan wakil gubernur serta sebab dan akibat hukum dari kekosongan Jabatan tersebut berdasarkan ketentuan perundang-undangan yang berlaku dan regulasi yang bersangkut paut dengan isu hukum serta didukung oleh beberapa literatur para ahli hukum Hasil yang diproleh penulis dari penelition ini antara: (1) hak pengajuan nama pengisi jabatan wakil gubemur yang kososng diberikan kepada partai politik pengusung, dan pengisisan dilakukan apabila masa jabatan masih tersisa 18 (delzpan belas) bulan. (2) lambannya proses pengisian jabatan wakil gubernur disebabkan oleh pergeseran kedaulatan, dari kedaulatan rakyat menjadi kedaulatan partai politik seta tidal adanya kepastian hukum batas waktu kekosongan jabatan diperbolehkan kosong. akibat hukum yang dialami oleh Provinsi DKI Jakarta adalah tidak terlaksananya tagas wakil gubernur dan rendahnya pelayan terhadap ‘masyarakat. / DKI Jakarta Province has experienced the vacant position of deputy governor for more than | (one) year since Sandiaga Salahudin Uno as deputy governor for the 2017-2022 period resigned. The mechanism for filling the vacancy has actually been regulated in the Election Law and the Regional Government Lav, but in its implementation there are many problems that slow the vacancy filling process. The vacancy of the office also of course has legal causes and consequences that will be experienced by the community and the Provincial Government of DKI Jakarta, The research method used is a normative juridical research method with a legislative approach where the authors analyze and describe the mechanism of filling the vacant position of the deputy governor as well as the legal causes and conscquences of the vacancy based on applicable laws and regulations and regulations relating to legal issues and supported by some legal experts literature The results obtained by the authors of this study include: (1) the right to submit a name for the position of deputy governor who is given to the supporting political parties, and the filling is carried out if the remaining tenure remains 18 (eighteen) months. (2) the slow process of filling the position of deputy govemor is caused by a shift in sovereignty, from the sovereignty of the people to the sovereignty of political parties and the absence of legal certainty the deadline for vacant positions is allowed to be vacant, The legal consequence experienced by DKI Jakarta Province is the non-implementation of the duties of the deputy governor and the low level of service to the comma.
