Abstract

Perkembangan globalisasi ini membuat tingkat kejahatan semakin tinggi terlebih lagi dalam tindak pidana penipuan. Banyak warga negara Indonesia yang melakukan penipuan untuk menguntungkan dirinya agar bisa menaikkan derajat ekonomi penghidupannya. Dan tidak memungkiri juga melakukan tindak pidana penggelapan demi mendapat barang yang seseorang inginkan. Permasalahan yang diteliti dalam penulisan ini mengapa hakim dalam putusannya menetapkan pelaku tindak pidana melanggar pasal 378 padahal pelaku melakukan dalam jabatan dan mengapa penjatuhan hukuman lebih berat terdahap terdakwa yang 1 (satu) dari pada terdakwa yang lainnya. Penelitian ini menggunakan penelitian hukum yuridis normatif dengan mengumpulkan bahan hukum (primer, sekunder dan tersier) melalui studi kepustakaan (library research). Bahan hukum yang dikaji adalah putusan pengadilan negeri jakarta selatan nomor 1004/Pid.B/2013/Jak.Sel. Untuk mendukung bahan hukum tersebut, juga dipergunakan bahan hukum sekunder dan tersier berupa buku, undang-undang, internet dan lain-lain. Dengan demikian, penjatuhan hukuman yang dijatuhkan hakim kepada para pelaku tindak pidana sudah tepat dan sesuai dan diharapkan dapat memberikan efek jera terhadap para pelaku tindak pidana penipuan. / The development of globalization has caused crime rates to increase especially high in criminal acts. Many citizens Indonesia is the one who commits fraud to benefit itself so that it can raise the economic level of livelihood. And don't deny it either committing a criminal act of embezzlement in order to obtain someone's goods want. The problem examined in this writing is why judges in imposed it on the perpetrator of the crime under article 378, in fact committing the perpetrator in office and why the punishment is more severe towards the honesty of 1 (one) from the honesty of the other. This research uses normative juridical legal research with collect legal materials (primary, secondary and tertiary) through studies librarianship (library research). The legal material studied is the decision South Jakarta District Court number 1004/Pid.B/2013/Jak.Sel. For To support these legal materials, secondary legal materials are also used and tertiary in the form of books, laws, internet and others. Thus, the sentence that the judge handed down to the perpetrators of criminal acts are appropriate and appropriate and are expected to do so provide a deterrent effect against perpetrators of criminal acts.
