Abstract
Konsumen yang dirugikan karena mengkonsumsi makanan kadaluwarsa harus mendapatkan ganti rugi sesuai dengan haknya. Terkadang pemberian ganti rugi tersebut belum sesuai. Seperti yang terjadi pada Putusan BPSK Garut bahwa Fitri Juliani telah menggugat Toserba Garut untuk ganti rugi Rp.15.000.000 hanya Rp.10.000.000 dikabulkan, tentu hal tersebut belum sesuai karena merujuk ke Pasal 19 Ayat (2) UU Perlindungan Konsumen. Rumusan masalah dalam skripsi ini adalah apakah bentuk perlindungan hukum terhadap hak-hak konsumen terkait penjualan makanan kadaluwarsa di garut, dan bagaimanakah putusan BPSK kabupaten garut nomor 18/Pdt.S-Brg/BPSK-GRT/IX/2020 dalam memutus tentang ganti rugi terhadap hak-hak konsumen. Metode yang digunakan dalam penelitian ini adalah normatif dengan pendekatan undang-undang, pendekatan analitis, dan pendekatan kasus. Data yang digunakan antara lain berupa Undang-Undang Perlindungan Konsumen, dan regulasi terkait penelitian ini, serta literatur berupa buku-buku atau jurnal. Berdasarkan penelitian ini disimpulkan bahwa bentuk perlindungan hukumnya secara represif belum terlindungi karena lemahnya sanksi yang dijatuhkan Majelis BPSK Garut kepada tergugat yang juga tidak tercermin keadilan bagi hak konsumen. Kata Kunci: Perlindungan Hukum, Hak-Hak Konsumen, Produk Makanan Kadaluwarsa. / Consumers who are harmed by consuming expired food must receive compensation according to their rights. Sometimes the provision of compensation is not appropriate. As happened in the Garut BPSK decision that Fitri Juliani had sued the Garut Department Store for compensation of Rp. 15,000,000, only Rp. 10,000,000 was granted, of course this is not appropriate because it refers to Article 19 Paragraph (2) of the Consumer Protection Law. The formulation of the problem in this thesis is what is the form of legal protection for consumer rights related to the sale of expired food in Garut, and what is the decision of the Garut Regency BPSK number 18/Pdt.S-Brg/BPSK-GRT/IX/2020 in deciding on compensation for consumer rights. The method used in this research is normative with a statutory approach, analytical approach and case approach. The data used includes the Consumer Protection Law, and regulations related to this research, as well as literature in the form of books or journals. Based on this research, it is concluded that the repressive form of legal protection has not been protected because of the weak sanctions imposed by the Garut BPSK Council on the defendant which also does not reflect justice for consumer rights.
