Abstract

Perlindungan hukum terhadap saksi pelapor pada tindak pidana korupsi merupakan bagian dan perlindungan terhadap hak asasi manusia, karena saksi dalam perkara korupsi dianggap sebagai partisipasi masyarakat untuk mengungkap tindak pidana yang sangat merugikan negara, sehingga negara mempunyai kewajiban untuk melindungi hak-hak asasi warga negaranya, akan tetapi banyak masyarakat yang tidak mau / enggan menjadi saksi, dengan alasan tidak adanya perlindungan hukum yang jelas khususnya terhadap saksi pelapor tindak pidana korupsi. Peran dari seseorang yang melaporkan tindakan di sekitarnya, terutama di dalam instansi tempat dia bekerja, atau yang disebut sebagai whistleblower sangat penting dalam upaya pemberantasan korupsi yang ada di Indonesia. Metode pendekatan yang dipergunakan dalam penelitian ini adalah penelitian yuridis normatif yaitu yang menganalisis hukum secara tertulis, bahan kepustakaan dan studi dokumen dijadikan sebagai bahan utama sementara data lapangan melalui wawancara dijadikan data pendukung/pelengkap. Analisis Data, setelah semua data sekunder diperoleh melalui studi kepustakaan (library research), serta data pendukung dari hasil wawancara, dilakukan pemeriksaan dan evaluasi untuk mengetahui validitasnya, kemudian data dikelompokkan atas data sejenis. Data kualitatif ditafsirkan secara yuridis, logis, sistematis menggunakan metode deduktif dan induktif. Terhadap Saksi Pelapor tindak pidana korupsi (Whistleblower) dalam Putusan Pengadilan Tinggi Bandung Nomor: 32/Pid.Tpk/2022/PT Bdg berdasarkan Undang-Undang Nomor 13 Tahun 2006 jo Undang-Undang Nomor 31 Tahun 2014 tentang Perlindungan Saksi dan Korban telah mendapatkan perlindungan hukum, akan tetapi kurang maksimal karena sebelumnya pelapor telah ditetapkan sebagai tersangka oleh penyidik tanpa adanya alat bukti yang kuat. Oleh karena itu, whistle blowing system harus terus dibenahi mulai dari aturan dan implementasinya, agar perlindungan terhadap pelapor tindak pidana korupsi (Whistleblower) dapat terjamin. Kata Kunci: Perlindungan Hukum, Whistleblower, Tindak Pidana Korupsi. / Legal protection for witnesses who report corruption is part of the protection of human rights, because witnesses in corruption cases are considered part of the community to reveal crimes that are very detrimental to the state, so that the state has an obligation to protect the human rights of its citizens. but many people do not want / are reluctant to become witnesses, on the grounds that there is no clear legal protection, especially for witnesses who report corruption. The role of someone who reports actions around him, especially in the agency where he works, or what is known as a whistleblower is very important in efforts to eradicate corruption in Indonesia. The approach method used in this study is normative juridical research, which analyzes written law, library materials and document studies are used as the main material while field data through interviews is used as supporting/complementary data. Data analysis, after all secondary data has been obtained through library research, as well as supporting data from interviews, an examination and evaluation is carried out to determine its validity, then the data is grouped into similar data. Qualitative data is interpreted juridically, logically, systematically using deductive and inductive methods. For Corruption Crime Reporters Witness (Whistleblower) in the Bandung Number: 32/Pid.Tpk/2022/PT Bdg High Court Decision based on Law Number 13 of 2006 jo Law Number 31 of 2014 concerning the Protection of Witnesses and Victims have received legal protection, but not optimally because previously the whistleblower had been determined as a suspect by investigators without strong evidence. Therefore, the whistle blowing system must continue to be improved starting from the rules and their implementation, So that protection for whistleblowers of corruption crimes can be guaranteed.
