Abstract

Setelah terbitnya Undang-undang Cipta Kerja Republik Indonesia, menimbulkan adanya kewenangan Kementerian Kelautan dan Perikanan untuk menerbitkan sertifikat kelaikan kapal perikanan, yang sebelumnya merupakan kewenangan Kementerian Perhubungan. Hal ini membuat penulis tertarik untuk melakukan sebuah penelitian. Tujuan dari penelitian ini yaitu Untuk mengetahui dan menganalisis korelasi Peraturan Pemerintah Nomor 31 Tahun 2021 Tentang Penyelenggaraan Bidang Pelayaran dengan Peraturan Pemerintah Nomor 27 Tahun 2021 Tentang Penyelenggaraan Bidang Kelautan dan Perikanan dalam hal penerbitan sertifikat kelaikan kapal perikanan. Kedua, Untuk menjelaskan dan menganalisis dampak Peraturan Pemerintah Nomor 31 Tahun 2021 Tentang Penyelenggaraan Bidang Pelayaran dan Peraturan Pemerintah Nomor 27 Tahun 2021 Tentang Penyelenggaraan Bidang Kelautan dan Perikanan dalam hal penerbitan sertifikat kelaikan kapal perikanan di Pelabuhan Sorong. Jenis penelitian yang digunakan dalam penulisan ini adalah jenis penelitian Hukum Normatif yang menggunakan data sekunder yaitu dengan mengkaji peraturan - peraturan serta pustaka yang berkaitan dengan penelitian ini, selain itu juga dilakukan wawancara dengan pihak dan instansi yang terkait.Kesimpulan dari penelitian ini, pertama Korelasi Peraturan Pemerintah Nomor31 Tahun 2021 Tentang Penyelenggaraan Bidang Pelayaran Dengan Peraturan Pemerintah Nomor 27 Tahun 2021 Tentang Penyelenggaraan Bidang Kelautan Dan Perikanan dalam hal penerbitan sertifikat kelaikan kapal perikanan, adalah kedua peraturan tersebut berkaitan dengan tugas dan kewenangan dari Kementerian Perhubungan dan Kementerian Kelautan dan Perikanan yang mengalami perubahan dalam hal penerbitan Sertifikat Kelaikan Kapal Perikanan. Kedua, Dampak Peraturan Pemerintah Nomor 31 Tahun 2021 Tentang Penyelenggaraan Bidang Pelayaran Dan Peraturan Pemerintah Nomor 27 Tahun 2021 Tentang Penyelenggaraan Bidang Kelautan Dan Perikanan dalam hal penerbitan sertifikat kelaikan kapal di Pelabuhan Sorong adalah beralihnya tugas dan tanggung jawab antara kedua instansi pemerintah tersebut, dimana semula kewengan tersebut merupakan tugas dan tanggung jawab Kementerian Perhubungan, kemudian setelah adanya peraturan ini, dialihkan kepada Kementerian Kelautan dan Perikanan. Hingga saat ini peraturan pemerintah tersebut belum dapat dilaksanakan sepenuhnya, khususnya dalam hal penerbitan sertifikat kelaikan kapal perikanan di pelabuhan Sorong, sebab tidak tersedianya sumber daya manusia di Kementerian Kelautan dan Perikanan untuk melaksanakannya Kata Kunci : Sertifikat Kelaikan Kapal Perikanan, Implementasi Hukum, dan Pelayaran / IMPLEMENTATION OF GOVERNMENT REGULATION NUMBER 31 OF 2021 CONCERNING THE IMPLEMENTATION OF THE SHIPPING SECTOR AND GOVERNMENT REGULATION NUMBER 27 OF 2021 CONCERNING THE IMPLEMENTATION OF THE MARINE AND FISHERIES SECTOR IN THE ISSUANCE OF CERTIFICATE OF SEAWORTHINESS OF FISHING VESSELS AT SORONG HARBOUR After the publication of Republic of Indonesia’s Omnibus Laws, it gave the Ministry of Maritime Affairs and Fisheries the authority to issue certificates of seaworthiness for fishing vessels, which previously belonged to the Ministry of Transportation. This reason makes the author interested in conducting a research. The purpose of this study is to determine and analyse the correlation of Government Regulation Number 31 of 2021 concerning the Implementation of the Shipping Sector with Government Regulation Number 27 of 2021 concerning the Implementation of the Maritime Affairs and Fisheries Sector in terms of issuing certificates of seaworthiness of fishing vessels. Second, to explain and analyse the impact of Government Regulation Number 31 of 2021 concerning the Implementation of the Shipping Sector and Government Regulation Number 27 of 2021 concerning the Implementation of the Maritime Affairs and Fisheries Sector in terms of issuing certificates of seaworthiness of fishing vessels at Sorong Port. The type of research used in this writing is a type of Normative Legal research supported by Secondary data. This research is doing by learning and reviewing regulation and some literature related to this research, interviews were also conducted with government parties and agencies that related to this research. The conclution of this research, firstly, Correlation of Government Regulation Number 31 of 2021 concerning the Implementation of the Shipping Sector with Government Regulation Number 27 of 2021 concerning the Implementation of the Maritime Affairs and Fisheries Sector in terms of issuing certificates of seaworthiness of fishery vessels, is that both regulations are related to the duties and authorities of the Department of Transportation and the Maritime Affairs and Fisheries Service have changed. Second, the impact of Government Regulation Number 31 of 2021 concerning the Implementation of the Shipping Sector with Government Regulation Number 27 of 2021 concerning the Implementation of the Maritime Affairs and Fisheries Sector in terms of issuing certificates of seaworthiness of fishery vessels at the Port of Sorong is the shift in duties and responsibilities between two government agencies. Previously, the authority of these are the duty and responsibility of the Ministry of Transportation, then after this regulation, it was transferred to the Ministry of Maritime Affairs and Fisheries. Until now, these government regulations have not been fully implemented, especially in terms of issuing Certificate of Seaworthiness for Fishing Vessel at the port of Sorong, due to unavailability of human resource at the Ministry of Maritime Affairs and Fisheries to implemented that regulations Keywords: Certificate of Seaworthiness for Fishing Vessel, Legal Implementation, and Shipping.
