Abstract
Dewasa ini transportasi mejadi kebutuhan yang sangat penting dalam perkembangan SDM atau SDA setiap Negara. Faktor kebutuhan tersebut mendorong lahirnya inovasi dalam sistem transportasi seperti moda transportasi berbasis online. Namun transportasi berbasis online ini tidak serta mendapat respon positif, sebab masih banyak masalah dari lahirnya moda transportasi berbasis online ini, salah satunya adalah sektor perlindungan hukum-nya. Oleh sebab itu penulis mengangkat penelitian tentang perlindungan hukum dalam transportasi berbasis online ini. Penelitian ini dilakukan dengan menggunakan metode penelitian Normatif. Hasil penelitian menunjukkan bahwa bahwa perlindungan hukum terahadap jasa transportasi online di Indonesia dapat ditelusuri dari adanya hubungan hukum para pihak yang berkaitan dengan transportasi online antara lain penyedia aplikasi memiliki hubungan kemitraan dengan pengemudi (driver) sedangkan antara penyedia layanan aplikasi dengan pengguna aplikasi diikat dalam hubungan antara pelaku usaha dan konsumen. Sebuah pertanggung jawaban tersebut diberikan kepada korban dengan cara memberikan tergantung kerugian yang ditimbulkan dari konsumen dan driver tersebut membantu kerugian tersebut. Dari bantuan kerugian tersebut adalah sebagai bentuk pertanggungjawaban driver kepada konsumen atas kelalaian driver yang mengakibatkan kerugian pada konsumen. Aspek perlindungan konsumen tersebut dipertegas sesuai dengan ketentuan Pasal 19 Undang-Undang tentang Perlindungan Konsumen. Dengan adanya peraturan ini, maka konsumen memiliki perlindungan hukum jika terjadi kerugian yang dialami pada saat menggunakan barang dan/atau jasa yang diberikan oleh penyedia layanan. Kata Kunci : Asuransi, Perlindungan Hukum, Transportasi Online In this era globalitation, transportation is a very important requirement in the development of human resources or natural resources in each country. These needs factors encourage the birth of innovations in transportation systems such as online-based transportation modes. However, online-based transportation is not and received a positive response, because there are still many problems from the birth of this online-based transportation mode, one of which is the legal protection sector. Therefore the author raised research on legal protection in the online-based transportation. This research was conducted using Normative research methods. The results showed that legal protection against online transportation services in Indonesia can be traced from the legal relationship of the parties relating to online transportation, among others, the application provider has a partnership relationship with the driver while between application service providers with application users are bound in the relationship bussines actors and consumers. A responbility is given to the victim by giving depending on the losses incurred from the consumers and the driver helps the loss. From the assistance of the loss is as a form of driver responbility to consemers for negligence of drivers which results in losses to consumers. The consumes protection aspect is reinforced in accordance with the provisions of Article 19 of the Law on Consumer Protection. With this regulation, consumers have legal protection in the event of a loss experienced when using goods and/or services provided by the service provider.
