Abstract

Keterwakilan perempuan dalam dunia politik masih terbilang sangat rendah dan tidak proporsional. Banyaknya hambatan dan tantangan menghambat perempuan berkiprah dalam dunia politik, sehingga diterapkannya affirmative action atau kebijakan afirmatif minimal keterwakilan perempuan 30% melalui UU No. 7 Tahun 2017 tentang Pemilihan Umum dalam upaya meningkatkan jumlah perempuan di parlemen. Akan tetapi, hal tersebut tidak sesuai dengan tujuan. Hal tersebut terlihat masih rendahnya keterwakilan perempuan di DPRD Kota Bekasi, yakni hanya mampu meraih 16% jumlah anggota legislatif perempuan. Rumusan masalah dalam skripsi ini adalah bagaimana pengaturan kebijakan affirmative action dan hak politik perempuan dalam hukum di Indonesia dan bagaimana keterwakilan perempuan dalam pemilu legislatif (Dewan Perwakilan Rakyat Daerah) Kota Bekasi periode 2019-2024 melalui kebijakan affirmative action. Metode penulisan yang digunakan penulis dalam penelitian ini adalah penelitian yuridis normatif yang menggunakan pendekatan perundang-undangan (statue approach), jenis bahan hukum, yakni bahan hukum primer dari peraturan perundang-undangan, bahan hukum sekunder dari buku-buku, jurnal, dan internet, serta bahan hukum tersier dari ensiklopedia, dengan metode pengumpulan data studi kepustakaan (library research). Dari hasil penelitian ini dapat disimpulkan bahwa hak politik perempuan dan kebijakan affirmative action telah terjamin oleh peraturan perundang-undangan di Indonesia. Namun dalam pelaksanaannya, di DPRD Kota Bekasi Periode 2019-2024 tidak maksimal lantaran kurangnya jaminan hukum dan dukungan pemilih dalam memilih perempuan sebagai wakil rakyat. / The representation of women in politics is still very low and disproportionate. The many obstacles and challenges prevent women from taking part in the world of politics, so that affirmative action or an affirmative policy of at least 30% women's representation is implemented through Law no. 7 of 2017 concerning General Elections in an effort to make more women members of parliament. However, this is not in line with what is to be achieved. This can be seen from the low representation of women in the Bekasi City DPRD, which is only able to reach 16% of the number of female legislative members. The formulation of the problem in this thesis is how to regulate affirmative action policies and women's political rights in law in Indonesia and how is the representation of women in the legislative elections (Regional People's Representative Council) of Bekasi City for the 2019-2024 period through affirmative action policies. The research method used by the author in this research is normative juridical research using a statutory approach, types of legal materials, namely primary legal materials from laws and regulations, secondary legal materials from books, journals and the internet, as well as tertiary legal materials from encyclopedias, using library research data collection methods. From the results of this reseach it can be concluded that womens’s political rights and affirmative action policies have been guaranteed by laws and regulations in Indonesia. However, in practice, the Bekasi City DPRD for the 2019-2024 period was not optimal due to a lack of legal guarantees and voter support in electing women as people's representatives.
