Abstract
Praktik desentralisasi asimetris dirubah melalui regulasi UU Otsus Papua yang baru secara yuridis, bahwa UU Nomor 22 Tahun 2021 tentang Perubahan Kedua UU Otonomi Khusus Papua, pemekaran Provinsi Papua tidak hanya mengakomodir konsep bottom up, tetapi juga top down. Konsep top down adalah inisiatif murni yang datang dari pemerintah dan DPR. Hal merupakan salah satu bentuk pelanggaran Hak Asasi Manusia (HAM) Orang Asli Papua (OAP) secara desentralisasi asimetris di Indonesia berdasarkan UU Otsus Papua. Studi ini bertujuan untuk menganalisis Dampak Pemekaran Daerah Otonomi Baru di Papua (Papua Selatan, Papua Tengah dan Papua Pegunungan) terhadap desentralisasi asimetris dalam Undang-Undang Nomor 2 Tahun 2021 Tentang Otonomi Khusus di Papua. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif dan teknik analisis kualitatif. Hasil penelitian ini menunjukan bahwa kebijakan pemekaran DOB di Papua memiliki motif politik yaitu, motif insentif materiil dan motif insentif idealism. Hal ini, sangat berimplikasi pada sosial, politik, ekonomi, pembangunan, keamanan, pertahanan dan budaya Papua. perlunya pembenahan dan sinkronisasi Undang-Undang Nomor 2 Tahun 2021 Tentang Otonomi Khusus Papua, dengan melibatkan MRP sebagai representasi kultural Orang Asli Papua (OAP) sesuai tugas dan fungsinya berdasarkan Pasal 5 Ayat 1 dan 2 UU Otsus Papua./ The practice of asymmetric decentralization has been changed through the regulation of the new Papua Special Autonomy Law legally, that Law Number 22 of 2021 concerning the Second Amendment to the Papua Special Autonomy Law, the division of the Papua Province not only accommodates the bottom up concept, but also top down. The top down concept is a pure initiative that comes from the government and the DPR. This is a form of violation of the Human Rights (HAM) of Indigenous Papuans (OAP) in an asymmetrical decentralized manner in Indonesia based on the Papua Special Autonomy Law. This study aims to analyze the impact of the expansion of the New Autonomous Region in Papua (South Papua, Central Papua and Highlands Papua) on the asymmetric decentralization in Law Number 2 of 2021 concerning Special Autonomy in Papua. The method used in this research is normative legal research and qualitative analysis techniques. The results of this study indicate that the new autonomous regions expansion policy in Papua has political motives, namely, material incentive motives and idealism incentive motives. This has serious implications for the social, political, economic, development, security, defense and culture of Papua. the need for reform and synchronization of Law Number 2 of 2021 concerning Special Autonomy for Papua, by involving the MRP as a cultural representation of Indigenous Papuans (OAP) according to their duties and functions based on Article 5 Paragraphs 1 and 2 of the Papua Special Autonomy Law.
