Abstract

Tulisan ini mengkaji tentang nelayan tradisional NTT di perbatasan Australia yang telah berulang kali menimbulkan permasalahan bagi hubungan bilateral kedua negara. Jaminan hukum atas penangkapan ikan tradisional oleh nelayan- nelayan tradisional di perairan Australia sudah ada di konvensi hukum laut (UNCLOS) dan MoU Box 1974. Tujuan penulisan ini adalah untuk mengetahui bagaimana kebijakan pemerintah Indonesia dalam menyelesaikan persoalan tersebut untuk menjamin kesejahteraan nelayan-nelayan tradisional. Dalam memecahkan masalah penelitian, peneliti menggunakan konsep hukum laut internasional, konsep diplomasi dan konsep kebijakan publik serta metode yang digunakan dalam penulisan ini adalah metode penelitian kualitatif dan studi dokumen dalam membahas kebijakan pemerintah Indonesia terhadap nelayan-nelayan tradisional NTT. Hipotesis dalam penelitian ini adalah pemerintah memberikan pemahaman kepada nelayan-nelayan tradisional terkait kesepakatan-kesepakatan MoU Box 1974 dan konvensi hukum laut internasional dan bagaimana penerapan MoU Box dan hukum laut terhadap nelayan tradisional. Penelitian membuktikan bahwa kurangnya edukasi pemerintah kepada nelayan tradisional di Provinsi Nusa Tenggara Timur khususnya Kabupaten Rote Ndao sehingga menyebabkan pelanggaran-pelanggaran./ This paper examines the traditional fishermen of NTT on the Australian border which have repeatedly caused problems for the bilateral relationship between the two countries. Legal guarantees for traditional fishing by traditional fishermen in Australian waters already exist in the Law of the Sea Convention (UNCLOS) and the MoU Box 1974. The purpose of this paper is to find out how the Indonesian government's policy in solving these problems is to ensure the welfare of traditional fishermen. In solving research problems, researchers use the concept of international law of the sea, the concept of diplomacy and the concept of public policy and the methods used in this paper are qualitative research methods and document studies in discussing the Indonesian government's policies towards traditional fishermen in NTT. The hypothesis in this study is that the government provides understanding to traditional fishermen regarding the 1974 MoU Box agreements and international law of the sea conventions and how to apply the MoU Box and the law of the sea to traditional fishermen. Research proves that the lack of government education to traditional fishermen in East Nusa Tenggara Province, especially Rote Ndao Regency, causes violations
