Abstract

Perjanjian baku yang memuat klausula baku yang pada awalnya diterapkan dalam kegiatan bisnis dengan tujuan untuk menunjang efisiensi dan efektivitas, pada perkembangannya dianggap berpotensi atau telah berbenturan dengan keseimbangan para pihak dalam perjanjian dan melanggar asas-asas hukum perjanjian atau hukum kontrak yang berl aku di Indonesia. Rumusan masalah 1).Bagaimanakah interpretasi hakim terkait klausula baku menurut Undang-Undang Nomor 8 Tahun 1999 Tentang Perlind uii gan Konsumen ? 2). Bagaimanakah penerapan kl ausul baku terhadap konsumen dikaitkan dengan Putusan Hakim Pengadi1an Negeri Jakarta Pusat No. 53/Pdt. G/20 1 6 tanggal 1 4 Juni 2016. Metode Penelitian menggunakan penelitian hukum normatif dengan cara menel iti bahan pustaka atau d ata sekun der belaka. Kerangka teori yan g digunakan teori per lindungan hukum serta teori ke adilan.
