Abstract
Penelitian ini berangkat dari latar belakang mengenai permasalahan eksploitasi pekerja anak di industri hiburan. Anak-anak sering kali terlibat dalam pekerjaan di sektor entertainment, seperti akting atau menyanyi, yang pada praktiknya kerap mengabaikan hak-hak dasar mereka. Rumusan masalah dalam penelitian ini berfokus pada perlindungan hukum yang dapat diberikan kepada pekerja anak dari eksploitasi ekonomi dan sosial dalam industri hiburan. Penelitian menggunakan pendekatan teori perundang-undangan (statute approach) dan pendekatan kasus (case approach). Pendekatan perundang-undangan dilakukan dengan menelaah regulasi terkait, seperti Undang-Undang Cipta Kerja dan Undang Undang Perlindungan Anak, untuk memahami kerangka hukum yang ada. Pendekatan kasus digunakan untuk menganalisis peristiwa konkret terkait eksploitasi pekerja anak guna memberikan solusi praktis. Metode yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan studi kasus. Data yang diperoleh dianalisis secara sistematis terhadap bahan hukum tertulis. Hasil penelitian menunjukkan bahwa meskipun ada beberapa regulasi yang mengatur perlindungan anak, implementasinya masih lemah dan banyak anak yang tetap terjebak dalam situasi eksploitasi. Hasil penelitian menunjukkan bahwa perlindungan hukum bagi pekerja anak dalam industri hiburan telah diatur melalui Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja, serta Undang-Undang Nomor 35 Tahun 2014 tentang Perlindungan Anak. Namun, implementasi regulasi tersebut masih menghadapi berbagai tantangan, seperti minimnya pengawasan dan rendahnya kesadaran masyarakat. Penelitian ini menegaskan perlunya penguatan regulasi dan kolaborasi antara pemerintah, masyarakat, dan pelaku industri hiburan untuk memastikan terpenuhinya hak-hak anak. / This research departs from the background of the problem of child labor exploitation in the entertainment industry. Children are often involved in work in the entertainment sector, such as acting or singing, which in practice often deprives them of their basic rights. The problem formulation in this research focuses on the legal protection that can be provided to child workers from economic and social exploitation in the entertainment industry. The research uses a statutory theory approach (statute approach) and a case approach (case approach). A legislative approach is taken by examining related regulations, such as the Job Creation Law and the Child Protection Law, to understand the existing legal framework. A case approach is used to analyze concrete incidents related to the exploitation of child labor in order to provide practical solutions. The method used is normative legal research with a statutory approach and case studies. The data obtained was analyzed systematically against written legal materials. The research results show that although there are several regulations governing child protection, implementation is still weak and many children remain trapped in situations of exploitation. The research results show that legal protection for child workers in the entertainment industry has been regulated through Law Number 11 of 2020 concerning Job Creation, as well as Law Number 35 of 2014 concerning Child Protection. However, the implementation of these regulations still faces various challenges, such as minimal supervision and low public awareness. This research emphasizes the need to strengthen regulations and collaboration between the government, society and entertainment industry players to ensure the fulfillment of children's rights.
