Abstract

ABSTRAK Judul :Optimalisasi Peran Hukum Pada Perusahaan Pelayaran Terhadap Pencegahan Pencemaran Laut Oleh Sampah Sesuai Marine Pollution (MARPOL) 73/78 Annex-V Dari Kapal. Tujuan dari penelitian ini yaitu Pertama Untuk mengetahui, menganalisis dan menjelaskan persoalan yang menyangkut bagaimana strategi dalam penanganan pencegahan pencemaran laut oleh sampah dari kapal. Kedua, Untuk mengetahui, menganalisis, dan menjelaskan persoalan yang menyangkut bagaimana optimalisasi peran hukum perusahaan dalam upaya memberikan kesadaran awak kapal terhadap bahayanya membuang sampah ke laut. Penelitian ini adalah penelitian hukum normatif yang mempertimbangkan penelitian kepada analisis, adapun tehnik analisis data yang digunakan melalui data-data terkumpul dari bahan hukum dengan uraian melalui kalimat-kalimat yang efektif, teratur, dan logis sehingga menyederhanakan analisis hasil terhadap perumusan masalah. Kesimpulan dari penelitian ini, pertama Regulasi MARPOL 73/78 Annex V merupakan instrumen hukum internasional yang penting untuk mencegah pencemaran laut oleh sampah dari kapal. Regulasi ini telah diadopsi oleh lebih dari 150 negara, termasuk Indonesia. Regulasi ini melarang pembuangan sampah ke laut, kecuali dalam kondisi tertentu. Regulasi ini juga mengatur persyaratan khusus untuk pembuangan sampah tertentu, seperti sampah yang mudah terbakar, sampah yang mudah membusuk, dan sampah yang berbahaya. Kedua, Hukum perusahaan juga berperan penting dalam pencegahan pencemaran laut oleh sampah dari kapal. Hukum perusahaan dapat menjadi sarana untuk memberikan kesadaran kepada awak kapal tentang bahayanya membuang sampah ke laut. Dalam penerapan dan pengelolaan sampah di atas kapal, aktivitas-aktivitas mulai dari penampungan sampah sampai dengan pembuangan, semua harus dilakukan sesuai prosedur yang telah diatur dalam Annex V MARPOL 73/78, apabila pengelolaan sampah tidak dilakukan sesuai prosedur yang telah ditentukan maka pembuangan sampah akan terjadi dimana saja dan dimanapun kapal berada sehingga nantinya sampah yang dibuang sembarangan tersebut dapat mengakibatkan pencemaran di laut. Peran awak kapal dalam mencegah pencemaran di laut hendaknya dalam setiap kegiatan dilaksanakan dengan penuh tanggung jawab dan pengawasan yang ketat mulai dari pengumpulan, pemprosesan, penyimpanan, sampai pembuangan Kata Kunci: Hukum Perusahaan, Marine Pollution (Marpol) 73/78 Annex-V, dan Pencegahan Pencemaran Laut. / ABSTRACT Title : Optimisation of the Legal Role of Shipping Companies towards Prevention of Marine Pollution by Garbage in accordance with Marine Pollution (MARPOL) 73/78 Annex-V From the Ship The purpose of this research is firstly to find out, analyse and explain the issues concerning how the strategy in handling the prevention of marine pollution by garbage from ships. Second, to know, analyse, and explain the issues concerning how to optimise the role of corporate law in an effort to provide crew awareness of the dangers of throwing garbage into the sea. This research is normative legal research that considers research to analysis, as for the data analysis techniques used through data collected from legal materials with descriptions through effective, regular, and logical sentences so as to simplify the analysis of the results of the formulation of the problem. The conclusion of this research is, firstly, MARPOL Regulation 73/78 Annex V is an important international legal instrument to prevent marine pollution by litter from ships. This regulation has been adopted by more than 150 countries, including Indonesia. It prohibits the discharge of rubbish into the sea, except under certain conditions. It also regulates specific requirements for the disposal of certain waste, such as flammable waste, decomposable waste and hazardous waste. Second, company law also plays an important role in the prevention of marine pollution by rubbish from ships. Company law can be a means to provide awareness to crew members about the dangers of dumping rubbish into the sea. In the application and management of waste on board ships, activities ranging from waste collection to disposal, all must be carried out according to the procedures regulated in Annex V MARPOL 73/78, if waste management is not carried out according to predetermined procedures, waste disposal will occur anywhere and everywhere the ship is located so that later the garbage that is disposed of carelessly can cause pollution at sea. The role of the crew in preventing pollution at sea should be carried out in every activity with full responsibility and strict supervision starting from collection, processing, storage, to disposal.
