Abstract

Dalam Undang-Undang No 17 Tahun 2008 tentang pelayaran diatur kewajiban perusahaan angkutan mengenai tanggung jawab asuransi terhadap keselamatan dan keamanan penumpang atau barang yang diangkutnya, termasuk dalam hal ini asuransi terhadap alat angkut. Dengan demikian, apabila perusahaan pengangkutan yang selaku pemilik kapal telah mengasuransikan tanggungjawabnya sesuai yang telah diatur dalam undang-undang pelayaran maka dapat mengalihkan tanggungjawab tersebut kepada perusahaan asuransi tersebut dengan prosedur klaim. Adapun juga penyelesaian sengketa terkait pelaksanaan pertanggungan asuransi angkutan laut dibawa ke forum arbitrase. Metode yang dipergunakan dalam kajian penulisan tesis ini adalah penelitian hukum normatif, yaitu mengkaji peraturan perundang- undangan yang berlaku dan pembahasan dalam penelitian ini yang bersifat normatif Penelitian hukum normatif atau disebut juga penelitian hukum kepustakaan, yaitu penelitian hukum yang dilakukan dengan cara meneliti bahan pustaka atau data sekunder. Dari hasil penelitian di peroleh bahwa Sengketa asuransi angkutan laut di Indonesia biasanya terkait pembayaran klaim asuransi. dalam hal ini dapat berupa tidak dilakukannya pembayaran klaim asuransi oleh penanggung, kekurangan bayar klaim asuransi oleh penanggung, dan/atau ditolaknya permohonan klaim tertanggung oleh penanggung, Lahirnya Undang-Undang Nomor 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa merupakan alternatif penyelesaian sengketa melalui langkah non litigasi. Selanjutnya, Pemerintah dan perusahaan asuransi memberikan perlindungan hukum kepada angkutan laut dalam proses klaim asuransi. Tujuan dari perlindungan hukum ini adalah untuk memberikan kepastian hukum kepada tertanggung dalam hal terjadi kerugian karena peristiwa yang diperjanjikan. Peraturan perundang- undangan jelas mengatur prosedur klaim asuransi angkutan laut. Ini dilakukan untuk mencegah sengketa dan memastikan proses klaim berjalan lancar. From the results of the research obtained that sea transport insurance disputes in Indonesia are usually related to the payment of insurance claims. in this case it can be in the form of non-payment of insurance claims by the insurer, underpayment of insurance claims by the insurer, and / or rejection of the insured's claim application by the insurer, the birth of Law Number 30 of 1999 concerning Arbitration and Alternative Dispute Resolution is an alternative dispute resolution through non-litigation steps. Furthermore, the Government and insurance companies provide legal protection to sea transport in the insurance claim process. The purpose of this legal protection is to provide legal certainty to the insured in the event of a loss due to the promised event. The laws and regulations clearly regulate the procedure for sea transport insurance claims. This is done to prevent disputes and ensure the claims process runs smoothly.
