Abstract

Pemerasan dan Pengancaman kerap terjadi dilingkungan masyarakat terkhususnya di ibu kota Jakarta. Pemicu terjadinya tindak pidana pemerasan dan pengancaman diakibatkan meningkatnya jumlah pengangguran serta kurangnya kesejahtraan dimasyarakat. Dengan sulitnya mendapat kerja serta dorongan kebutuhan sehari-hari terkadang masyarakat lebih memilih jalan pintas untuk mendapatkan apa yang mereka butuhkan bahkan inginkan. Dalam pembahasan ini penulis akan memaparkan peranan korban serta faktor dan upaya dalam tindak pidana pemerasan dan pengancaman. Jenis survei yang digunakan dalam penelitian ini adalah normatif dan yuridis. Studi normatif mempelajari data bibliografi atau sekunder, termasuk hukum primer dan sekunder. Penelitian ini menggunakan metode berdasarkan hukum perpustakaan, buku-buku ilmiah, peraturan perundang-undangan terkait, dan studi kepustakaan dari mata kuliah, jurnal, atau website terkait untuk memecahkan masalah tersebut. Hasil penilitian menyatakan bahwa penegakan hukum terhadap pelaku tindak pidana pemerasan dan pengancaman dikenakan Pasal 368 KUHP serta peranan korban dalam suatu tindak pidana pemerasan dan pengancaman. / Extortion and threats often occur in the community, especially in the capital city of Jakarta. Triggers for the occurrence of criminal acts of extortion and threats are caused by the increasing number of unemployed and the lack of welfare in the community. With the difficulty of getting a job and the encouragement of daily needs, sometimes people prefer shortcuts to get what they need and even want. In this discussion the author will describe the role of the victim as well as the factors and efforts in the crime of extortion and threats. The type of research used in this research is normative juridical. In normative research, what is examined is a bibliography or secondary data that includes primary and secondary law. This research uses the library method, which is a method based on literature studies of scientific books, related laws and regulations, as well as related courses and journals or websites related to solving these problems. The results of the study state that law enforcement against perpetrators of criminal acts of extortion and threats is subject to Article 368 of the Criminal Code and the role of victims in a criminal act of extortion and threats
