Abstract

Zaman modern saat ini, Perkembangan dunia globalisasi bukan hal yang asing lagi bagi semua negara maupun segala penjuru di dunia. Sehingga memberikan dampak yang bernilai positif dan negatif, Bagaimana penanganan Satgas Waspada Investasi dalam melakukan Penyidikan Tindak Pidana Investasi Bodong dan Bagaimana efektifitas hukum pidana dalam penanganan kasus Robot Crypto Fahrenheit. Penelitian ini merupakan penelitian hukum normatif dengan pendekatan kasus (Case Approarch) dan pendekatan perundang-undangan (Statute Approarch). Data yang digunakan adalah data menginventarisasi, mempelajari dan mengaplikasikan konsep-konsep, asas-asas dan norma hukum yang diperoleh dari data primer, sekunder dan tersier, kemudian bahan hukum yang terkumpul disusun dan dianalisis. Dari hasil penelitian ini dapat disimpulkan bahwa Satgas Waspada Investasi dalam melakukan Penyidikan Tindak Pidana Investasi Illegal dapat dilihat pada POJK Nomor 22/ POJK.01/ 2015 Tentang Penyidikan Tindak Pidana di Sektor Jasa Keuangan dan POJK Nomor 31/POJK.04.2015 Tentang Keterbukaan Atas Informasi atau Fakta Material oleh Emiten atau Perusahaan Publik yang pada intinya menjelaskan kewenangan penyidikan terdapat pada Pasal 1 Angka (1) POJK 22/POJK.01/2015 dimana penyidikan kasus investasi illegal merupakan kewenangan OJK. Kata Kunci : Hukum Pidana, Investasi, Satgas, Robot Crypto Fahrenheit./ In modern era, the development of the world of globalization is not foreign to all countries and all corners of the world. So that it has a positive and negative impac. How to handle the Investment Alert Task Force in conducting investigations on fraudulent investment crimes and how effective the criminal law is in handling cases of the Crypto Fahrenheit Robot. This research is a normative legal research with a case approach (Case Approarch) and a statutory approach (Statute Approarch). The data used is inventory data, studying and applying the concepts, principles and legal norms obtained from primary, secondary and tertiary data, then the collected legal materials are compiled and analyzed. From the results of this study, it can be concluded that the Investment Alert Task Force in conducting Investigations on Illegal Investment Crimes can be seen in POJK Number 22/POJK.01/2015 concerning Criminal Acts in the Financial Services Sector and POJK Number 31/POJK.04.2015 Regarding Disclosure of Information or Material facts by Issuers or Public Companies which essentially explain the authority of the investigation are contained in Article 1 Number (1) POJK 22/POJK.01/2015 where the investigation of illegal investment cases is the authority of OJK.
