Abstract
Untuk menghindari ancaman disintegrasi bangsa, kemudian negara melakukan pendekatan otonomi khusus di Papua dengan Undang-undang Nomor 21 Tahun 2001 kemudian diubah Undang-undang Nomor 2 Tahun 2021, sesuai ketentuan pasal 18B ayat (1). Walau demikian, masalah di Papua masih terus terjadi.. Apakah undang-undang tersebut memenuhi ketentuan desentralisasi asimetris dan prinsip konstitusi? Jenis penelitian ini adalah penelitian normatif dengan pendekatan statute approach. Dalam pembuatan undang-undang tidak ada partisipasi rakyat, naskah akademik menjadi masalah, problematika daerah tidak dirumuskan dalam undang-undang. Dalam pelaksanaan Undang-undang Nomor 21 Tahun 2001 terbukti tidak berhasil. Kemudian dilakukan perubahan dengan Undang-undang Nomor 2 Tahun 2021. Perubahan pun tidak ada partisipasi rakyat, bahkan perubahan undang-undang dimasukan dua pasal bersifat sentralistik. Prinsip dasar desentralisasi asimetris dan semangat konstitusional tidak dilaksanakan dan dirumuskan. Karenanya, harus dirumuskan ulang undang-undang atau dilakukan perundingan untuk membuat undang-undang desentralisasi asimetris yang partisipatif seperti Aceh./To avoid the threat of national disintegration, the state then took a special autonomy approach in Papua with Law Number 21 of 2001 and then Law Number 2 of 2021 was amended, in accordance with the provisions of Article 18B, paragraph (1). However, problems in Papua still persist. Does the law fulfill the provisions of asymmetric decentralization and constitutional principles? This type of research is a normative research with a statute approach. In the process of making laws, there is no people’s participation, academic texts are a problem, regional problems are not formulated in the law. In the implementation of Law No. 21 of 2001 proved unsuccessful. Then changes were made to Law Number 2 of 2021. The changes did not include people’s participation, even changes to the law included two centralistic articles. The basic principles of asymmetric decentralization and constitutional spirit were not implemented and formulated. Therefore, the law must be reformulated or negotiated to create a participatory asymmetric decentralization law like Aceh.
